Is Sunny 95.5 (K238AV) running legally? (Marysville, CA)

Sunny 95.5 (K238AV) is one of these "super translators" rebroadcasting KYCY 103.1 HD-2.

I listened to it over the weekend and it sounds great. When I flipped over to KYCY103.1 HD-2, I heard the same content but out of phase and sounding terrible. It was also delayed from the broadcast heard on 95.5. If 95.5 is truly re-broadcasting 103.1 HD-2 this isn't possible.

So how again is this legal?
 
No, it's legal because of part 74.1231:

"However, an FM translator providing fill-in service may use any terrestrial facilities to receive the signal that is being rebroadcast."

If you had the choice of a bit-starved HD2 signal or a real STL as your means of delivery what would you use?

I can see this thread generated a tremendous amount of chatter. Went camping this past weekend and listened to 103.1 HD2 for a few minutes to observe that things haven't changed.

I concur with Dave B, looks like the FCC doesn't care about North State radio. :)
