Activist San Diego's KUMI-FM is officially kaputski!

Well, it looks like Activist San Diego's attempt to extend the reach of their kind of signal in San DIego, KNSJ-FM, is over.

Just read a letter from the station's FCC correspondence folder that they are reliquishing their hold on KUMI-FM in Ramona.

The letter does not address whether the station was operational or not. Interestingly, the letter is from the station's "acting" General Manager and not from their law firm in Washington DC (which they couldn't afford even to send them several cups of Starbucks coffee in a tray). Martin Eder was the guy behind KNSJ-FM in the first place.

Federal Communications Commission - FM License Division 45 L Street NE Washington, DC 20554 We received a letter from the FCC on June 30, 2021. We learned that last October 13, 2020, the Tribal Chairmen’s Association and the Chairman of Los Coyotes filed complaints with the FCC related to KUMI 89.9 FM. This was the first time that we were aware of these complaints, so for that reason had not replied earlier. . We understand from their complaint that Tribal Chairmen’s Association, a 501c3, similar to ASD/KUMI, is interested in obtaining this frequency to cover adjacent locations. Activist San Diego as the license holder to KUMI 89.9 FM Ramona, CA offered to transfer the license to the non-profit Tribal Chairmen’s Association. Having heard nothing in return from the Association and wanting to avoid any perceived dispute, we have decided to relinquish our ownership of the frequency and the FCC license. With this letter Activist San Diego as the license holder to KUMI 89.9 FM voluntarily relinquishes our FCC broadcast license for 89.9 FM, Ramona, CA hoping to serve the greater good. Activist San Diego came in as a wimper, and left as a wimper.

The lettter does not even mention the name of the incorporated licensee, "Activist San Diego" until the third paragraph and it does not appear in the heading or in the signature legend. Their ignorance is manifest.

Which I'm sure was intentional, to avoid any admission of violation of FCC rules or potential fraud.
 
I'm sure KNSJ thinks it's politically correct to donate 89.9 to another "oppressed" group (a.k.a. the Los Coyotes tribe) But I don't believe Activist San Diego can just "give" their CP directly to an outside entity. Can someone on this board elaborate on the transfer process?
 
From what I read above, they offered to submit an application to transfer control to the Los Coyotes Tribe but they did not respond. Thus, they gave up the license, likely to prevent the FCC from pressing further on whether the station had been actually constructed and was operational as per their prior application. A station can apply to transfer a station via application to a willing party that meets the qualifications with the FCC. The FCC then approves or rejects the application. If the station in question had not been constructed and was operational when the application for a license was filed, the licensee would be found to demonstrate a lack of candor and perjury, two very solid reasons for the FCC to label the organization as unfit to hold a license. By this, I mean if they had additional stations, they could lose those licenses as well as not being accepted as an applicant for a future station.

How much cash does a renewal cost? Is it filled out by the station management or is it filed by the Washington DC attorneys?

Some stations fill in their own renewal application. Others use an attorney that specializes in FCC and radio station regulatory matters. The cost can be anywhere from minimal to well over $10 thousand. At the high end would be cases with extreme ownership issues, or ones that have not complied with certain rules.

Non commercial stations do not pay FCC filing/user fees.
But they do have to pay other costs, such as an attorney who specializes in renewals and the like unless they want to run the risk of further issues. Given their bad experience with the other license, they'd be prudent not to do it themselves.
 
Thanks for all of this great information, David! Once again, you really nailed it.

I somehow had it in my head that their renewal was up on August 1st, Perhaps the August 1st deadline was in reference to KUMI-FM.
