So what if Touch lets their jocks swear? As if that's the biggest legal problem with that station.

Why on earth are these guys on the air? Ditto 102.9 and 101.3, which come in better in Roslindale than 99.5 (which I really wish I could get).

What's a license for, then? I'm surprised the major owners haven't complained.

Of course they've complained.

Thats why they've gotten legal notices, FCC visits and fines.

They might lose their freedom. The last guy to run a pirate station who deliberately waved it in the FCC's face after receiving the same warnings, fines and FCC visits (which he didn't allow either) ended up doing five years in prison.

99.5? Did you recently have a lobotomy? If not, why would you want to get it. Go to Borders Bookstore and buy a CD called "All the classical music you will ever need", and play it over and over again. No difference,

Why would it attack a radio station 250 miles away (Hot 97)?

Touch 106.1's <500 watts at near ground level doesn't come close to Jamn' 94.5's 50000 watts (equivalent)

Remember CD's cost $$$.

Radio is Free!

And WCRB is local...with local news, information, hosts and weather. None of which you get from a CD.

If a CD was enough for you....you wouldn't be complaining about it every two seconds.

I find it hard to believe that any pirate operator running a signal in or around the Boston area would do any jail time right about now... I mean how many times has Touch been visited in the past two years?

I think the FCC is too soft, sort of like parents with spoiled kids "If I ever catch you doing that again" (for the 100th TIME)

If they seriously, seriously want to crack down on these pirates, an example should be made out of a few of them. Word travels fast, and I don't think ANYONE, no matter how much they favor a particular format or genre of music, would want to risk their own personal freedom (especially since most of these illegal operators are probably boradcasting on a volunteer basis).

If the FCC is serious of cracking down on these pirates, then it should be one visit: warning, hefty fine, xmitter confiscated ... ... second visit: jail time.

Will never happen. And don't give me the "oh they don't know where they are" excuse, they know exactly where the operators are broadcasting from.

In the Tampa FL area, maybe three or four years ago. The scenario was exactly like it is with Touch: warning letters, FCC visits (which the guy did not allow...that all by itself is a rule violation), and equipment confiscation. He kept right on doing it and wound up in prison.

It's not that the FCC is soft. There are many factors at work, not the least of which is that, while the pirate operators just do what they please when they please, government cannot work that way. They need to establish a case that will withstand procedural and judicial scrutiny, and that takes time. It's also not as if the FCC has nothing else to do, and also not as if they have an endless supply of enforcement agents to take on the pirates. The FCC also regulates television, cable TV, satellite and common carriers like telephone and cell phone companies. Also, as we've seen in some cases, taking pirates to court can be a crap shoot. There have been some occasions in which judges have actually sided with the pirates (yes, it's true), although that usually gets overturned on appeal.

I cannot disagree with anything you said, but in order to make a swift and effective crackdown on pirates the enforcement provisions of Section 301 of the Communications Act will have to be changed, and only Congress can change them. I wouldn't go so far as to say it will "never happen," but we all know how slowly Congress moves on just about anything (unless, of course, we're talking about a bared nipple...).

Yup, comes right out and says pirate. One comment said that yup, one way to preach law and
order is from behind the mike of a pirate radio station! :)

He has good intentions with this rally. That being said, Touch is still illegal and hopefully this guy will wind up on a legit outfit.

Greater Boston (Emily Rooney's show) just had a piece about Touch FM... third segment. She interviewed the founder of the station and a professor from BU. The show's usually on demand on Comcast and they also have a webcast of the segments by the next day at http://www.greaterboston.org
