Can a Commercial Radio Station in CA Legally Air Ads for Medical Marijuana?

Hi Folks,

First time poster here with random question about Bay Area radio and medical marijuana dispensaries. Wondering if a federal law is being broken if a station were to air that type of spot. Your insight and thoughts are appreciated!
 
I've produced several of these types of commercials for a "major corporate radio station" in the past. The company's position from legal was that as long as the spots were in the spirit of the medical marijuana law, then they were OK to run. Legal would often review copy for approval and make minor changes once in a while.

A growing category, to be sure!
 
They can, I remember KLSX down here in L.A. having ads for medical marijuana occasionally. Not to mention, there was a big marijuana ad on the old site.
 
I forget which station, but I hear ads all the time for a place called Harborside Health Center in Oakland. Well done advertising, actually. They tout the fact that they provide scientific analysis of their product.

I had a dilemna with a local "smoke shop" that I did v/o for about 2 years ago. Careful wording got it on (a conservative newstalk station). Hey, money is money.
 
I was told by four people that on November 19, oldies station KCCL in Sacramento (actually,
licensed to Shingle Springs) ran spots for Canna Care, a medicinal marijuana outlet.

Thats really nice that you CA peeps can smoke pot as long as your doc says its ok,,, Given that most celebs and rich people live in CA and can buy off docs and lawers and cops.... Well isnt that nice. In the rest of the U.S you smoke pot, you go to jail, No Acceptions,, CA should be no different.. This is just like people like Tiger Woods getting off Scott Free.. BTW,, im not attacking the poster who was simply asking a question, nor am I attacking the radio stations for accepting paid ads, but if its legal in CA, it should be legal everywhere,, last I checked CA was part of the U.S.A,, not an extention of Ampsterdam, and guess what,, you get caught smoking or selling weed in the other 49 states, and your not a celeb or millionare, you go to jail..
 
Hey midwestern clubber - you sound like you could really stand to get a good quarter ounce and get a clue what medical cannabis is all about, and quit being jealous of movie stars, Hollywood, and people who get to have a cement pond. Maybe you need to do a little more traveling and see how other parts of the world get by without comparing everyone else to the only way you know. "Go to Jail?" What substance have YOU been imbiding?
 
I think most of the time possession gets you a fine, not jail time. And while this isn't the right place to start a discussion on marijuana legalization, I'll just say I'm for legalizing it. It's less harmful to society than alcohol, just tax it and make some money. Seems pretty simple to me.
 
I have nothing against anyone's opinion and am not here to attack the poster's... I think it should be legalized too. I have had to do 60 days home detention, and a year probation for getting into a car wreck,, cops threatened to arrest me if I didnt take a blood test,, all I had was small trace amounts in my system

You seem angry because California doesn't have the same draconian laws as your state. No, this isn't Amsterdam, but like it or not, in America, the 50 states can make their own laws. Federal law does trump state law in terms of drug use. That was a concern during the last administration, when the Bush Justice Dept threatened to bust medical marijuana operations in California. But it turned out to be mostly empty threats. The Obama Administration will likely keep a hands off attitude.

California is definitely ahead of the curve in terms of legalizing marijuana. But while voters were happy to to go as far as saying pot use was OK for "medical use," all the opinion polls say that they are NOT ready to vote for legalizing pot in general. That's still a ways off.

As far as I know, if you get into a car wreck in California, and the blood test says you have marijuana in your system, you're still in trouble.

May want to drop that to 48 states as Colorado ( some parts of the state anyway ) are actually very "pot" friendly as recenty the voters in the mountain town of Breckenridge made pot legal there.

Also in Denver I have noticed a HUGE increase in ads for medical marijuana on their local radio. Actually on some Denver stations like the new KONN HOT 107.1 FM, it seems every other ad they air is for someplace offering medical pot plus on top of that Denver's Westword Magazine now has their own "pot critic" and not too mention Denver cops are known to "look the other way" when it comes to marijuana use in that city and its been more/less that way for quite for awhile. Hmmm..another use for the term "Mile High City". But Denver, Breckenridge and of course Boulder are just three cities in Colorado where marijuana is ok. Still not a good idea to light up a joint say in Colorado Springs.
