Can NYC radio stations prohibit talent from working at XM or Sirius?

Put yourself in the PD chair. Do you want your talent working on the side at XM or Sirius? Can talent serve two masters? Take Ryan Seacrest for example. How many gigs does he have? Is he spreading himself too thin?

I don't think it fair to your employer to have other gigs on the side. I think its fair to say are you with us or the enemy?

If you need to make a living you do what you can. There is NO such thing in radio as "fair" or "loyalty". Radio is all for yourself.

It depends on your contract with the station. A good agent can get you a deal that lets you do other media (TV and, possibly satellite).

At WOR several of our personalities did TV at the same time they did radio for us. Many syndicated radio shows are also on satellite, though several companies are making noises about not carrying any network show that also appears on satellite. Saga has threatened to dump Hannity on their stations once his contract is up with them. As satellite grows I think we'll see a lot more of that.

Since ABC started charging for Hannity (a la Rush or Stern), it makes less sense for stations to shell out cash for a show that's played ad nauseum on both sats. Sure, 97+% of people will still listen on terrestrial radio, but it just seems silly. And a bargaining chip for smart operators. Imagine if Rush wanted to be on sat as well.

If Limbaugh wanted to be on satellite he'd do it. He's already driving listeners to his web stream rather than radio. At this point, he's still enough of a force in Talk Radio that stations will roll over and play dead. Once he's serving time as a druggie (you know, the people he rails against) that may change.

Unlike another certain host, he's smart enough to have said subscription levels will need to increase exponentially before he would consider it. By the time that happens, he'll nearly be in assisted living.
 
It depends on the contract. I suppose a PD could demand that an air talent work exlusively for them, but unless he compensates the talent appropriately, they won't be able to get their services at all. At this point satellite radio is in it's infancy and is not much of a competing threat to most terrestrial stations that it would require exclusivity contracts.

For the most part, satellite radio is looked on as that extra part time gig on the side that many full time radio people often have. For example, Michelle Visage from WNEW and Charlie Berger from WKTU work at Sirius for their "Beat" dance channel. This affects their respective stations very little. However, I'm sure that if Bill Lee were VT'ing the same shift he does at WKTU over at Sirius 36, KTU would have a problem with that. I'd be willing to bet their contracts spell out under what conditions talent can work at other non-competing outlets.
