Howie's lawyers: let him work at 96.9 in the meantime

Howie's lawyers are seeking to get a panel together to hear his complaint and get
permission to do his show at 96.9 while the case goes through court--which
could take up to a year. They argue that Howie's being able to accept a WTKK
deal on Sept. 20, but he couldn't as early as one day before that, is
"absurd". The Herald headline btw incorrectly states the call letters as "WTTK"
(calls that 100.7 had years ago)

Court may just rule that hey, he was still employed by Entercom when the offer
was made, and all he had to do was wait till Sept 20

I enjoy Howie's show but I agree with those who said he screwed up. He should have kept his trap shut until September 21st and then announced that he signed the deal. If he had, he'd be back on the air and making more than 800 large a year now.
 
At the rate this case is "moving" through the courts, by the time it's resolved, WRKO will be broadcasting mercenary preachers non-stop, and WTKKK will be playing smooth jazz again.
 
Yeah, that could well be the case. It's true that Howie should have kept quiet about the offer though
a post on boston-radio-interest mentioned that under his contract I guess he was encouraged in
good faith to mention any offers (right of first refusal). He did, and ...oops...

Howie must have asked his lawyers, how long do you think all this will take to go through the courts?
When they said it could take up to a year or more, he must have told them to do what they could
to "let me on WTKK in the meantime" because it could take awhile.

The interesting thing is depending on whom you ask, Howie could have waited till Sept 20 or 21 and
announced the deal then...OR he may have had to wait another 6 months. Some have said that
the right-to-match extended till 180 days after the expiration of the contract!

What I don't get is that when this first broke, it was said that Entercom hadn't given Howie an
offer by 6 months BEFORE the end of the contract (so, 3/19) and maybe Howie/his lawyers
thought that he was now some kind of free agent or something? Look back at the Herald and
Globe articles from around July 9, 10, etc and see what I mean*

*--I remember I flew back from Pittsburgh--a cartoon fan convention--on July 9 and by the afternoon
of that Monday, "Howie's going to WTKK" was the big news story.

Well, raccoon, what you left off is the rest of what Scotto said, "Silence is golden, Howie. Give them $7 million worth of gold.”

$7 million? uh, I don't think so.

1) even if he is able to achieve 5th place, he only gets about 10% more than current contract according to published reports,

2) he was 14th in the last ratings period (!) which would mean under the new agreement his annualized salary is only $450K (sounds like a pay cut to me), and

3) I seriously doubt that even the most fervant Howie fans would tune in to silence for too many days in a row.
 
I left off the rest because I don't want to quote too much on this site (due to "rights", etc.--quoting
from Herald article). But yeah.
 
Let Judge Judy Handle This ! ! !

How many times have I written that I would agrue that Howie cannot get a fair hearing before the state courts because of his attacks on many of its judges. Still, I think it is unlikely that what his lawyers are asking for which is injunctive relief by allowing Carr to go to 96.9 while that case is being heard will be granted. Still, his lawyers will have to exhaust all state court before seeking federal court relief.

I think this is a case for Judge Judy [btw happy 65th Judy] to bang heads and get this settled. It would be GREAT TV to get Howie Carr and Entercom on her show to settle this. Can you imagine the ratings.

back to howie - he will not broadcast on 96.9 unless and until this mess is decided.

i just don't see how he can get around the law.

i hope 96.9 has some serious plans in place to deal with this, beyond just some place-holder.
 
WTKK's plans are called: Get Imus In The Morning back before all its ratings tank.

Howie has no shot at getting on TKK while the case is heard. If I had to guess, I would say that he did that because his only strategy now is to stall the case and drag it out as long as possible in the hope that Entercom will permanently replace him and move on. This will take some time, so he takes a shot at the TKK thing, but I don't think anyone (other than perhaps some ill-informed folk at another site) holds out much hope that it will fly.

Addressing an earlier question, I believe what Entercom passed on was extending Howie's contract another year. That was the window that passed over the summer. They did so, I think, because they were heavily into renewal negotiations and were expecting to announce a new five year deal when Howie sprung the TKK surprise on them. That deadline/clause was separate from the other clauses at issue in the court case.

So, if Howie heads back to 'RKO, will he take the advice...?

entercom willl suspend him for unprofessional conduct without pay and that will be it.
he'll sit and wait more. he still won't be able to come over to wtkk.

like i said before, no judge in this state will help him with his contract troubles.
he'll have to take his case out of the country. his lawyers will get him the judgement he
wants out in mexico or brazil. that's his only shot.
 
I agree with this point. I could be wrong but it seems that Howie was so hell-bent on sticking it to him, that he jumped the gun. In the end, he is going to pay a ton of money for lawyers whether this goes his way or not. And we all know how Howie is about money!
