New York State Attorney General Eliot Spitzer filed a lawsuit against radio chain Entercom Communications on March 8, alleging the company illegally traded airtime for pay. Evidence made public by Spitzer as exhibits to his complaint link Madison's 105.5 Triple M (WMMM), which is owned by Entercom, to two of the alleged deceptive practices.The first involves "CD Preview," a program created by Entercom corporate management in 2001. The suit describes the program as a formal channel through which record labels were encouraged to buy sets of song "spins" to be played by certain Entercom stations in the overnight hours when listenership was at its lowest.According to Spitzer's complaint, Entercom explicitly offered "CD Preview" to record labels as a means to increase airplay detection, thereby improving a song's chart position. Songs become Top 40 hits based on radio airplay frequency. Charting services such as Broadcast Data Systems (BDS) use "electronic fingerprinting" to automatically detect spin frequency.In an exhibit to his complaint, Spitzer attached a one-page Entercom itemization of station-specific price listings for the number of "CD Preview" spins. Is radio station payola in Madison a recent phenomenon? Rich Albertoni investigates this in Isthmus in Triple M linked to payola allegations. As detailed in a lawsuit filed against Entercom Communications on March 8 by New York State Attorney General Elliot Spitzer, Entercom-owned stations are allegedly engaging in the practice. "Evidence made public by Spitzer as exhibits to his complaint link Madison's 105.5 Triple M (WMMM)," Albertoni writes, "to two of the alleged deceptive practices."Albertoni details the allegations presented in a March 8 press release from Spitzer's office, including those pertaining to WMMM. Remember that ALL of the allegations against Entercom are because the companyand it's group PD instructed the stations and PDs to use the CD preview program to generate promotion and marketing dollars. None of the cash went to local PDs and they were under orders to maximize the income from labels. This is something that Entercom corporate programmers dreamed up and now it is tainting the companies PDs and call letters across the country. Wonder if it was worth it?
 
WMYX and WXSS ran CD Preview during the overnights as well. I never knew it was anything illegal. I figured that would be OK as long as they said it was paid for. And at the end of every program the announcer would say "we're brought to you this time by () records. Keep listening there's more new music coming up right here on CD Preview."
 
Spitzer is clearly on a witch hunt and trying to run for Governor. He's also mad at Entercom (a a couple of other companies) because they refuse to settle and have demanded their day in court. It is at that point that Spitzer becomes Barney Fife without the bullet.

A new document emerges in an investigation of illegal pay-for-play practices

A new document linking Madison's 105.5 Triple M (WMMM) to alleged payola practices was made public on June 15. The document was part of the evidence released by New York state attorney general Eliot Spitzer in support of his $3.75 million settlement with the record label EMI.

The document is a May 2002 e-mail message from independent promoter Michele Clark to an unidentified representative of EMI's Virgin Records. It describes specific airplay to be provided by Triple M in exchange for a contest give-away to see a Rolling Stones concert in Chicago, as well as free tickets to that concert for former Triple M program director (PD) Tom Teuber. ...

It was a New York lawsuit with a Madison angle, and it ended Dec. 21 with a settlement that precluded a court finding of liability.

The People of the State of New York vs. Entercom Communications was filed by former attorney general (now governor) Eliot Spitzer on March 15, 2006. Spitzer’s complaint alleged that Entercom had engaged in deceptive business activities in New York state by choosing songs for broadcast based on “payments or consideration from record labels or their representatives without disclosure to the public.”

The Madison angle involved evidence (“exhibits”) submitted by Spitzer that alluded to Madison’s 105.5 Triple M, one of more than 100 radio stations in the U.S. owned by Entercom. ...
