KZPO-FM License cancelled, callsign deleted by letter dated 5-26-09

The FCC has just released a notice that they have canceled the license of KZPO-FM.

I read that last week in the FCC daily digest. From what I have heard the station plans to stay on with no valid license.
 
It seems that KZPO-FM forgot to file a renewal for their license that expired in Dec 2005. That is why the FCC has canceled and deleted KZPO's license.
 
Seems that KZPO DID file a renewal application and did pay the fees, but the FCC did not receive the application. A copy of the exhibits submitted with the petition for recon includes copyies of the check that was cashed by the Mellon Bank, and stamped receipts from the bank accepting the application and payment. Under FCC rules the station will remain "on the air" pending the out come of the renewal application and petition for recon. It appears that the Mellon Bank did NOT forward the application on to the FCC or that the FCC lost the application. It also appears that KZPO had already contacted the FCC about this matter years ago and that the FCC had NOT responded. Just another lost application.

That's interesting to know. Are station applications routinely sent to Mellon Bank rather than the FCC? It seems to me that it would make more sense to send the application to the FCC, rather than the bank, but government policies can sometimes be ... um, strange.

How long has this been FCC policy?
 
I am correct. I am looking at the letter to the licensee from the FCC saying that since they did not file for a renewal it is canceled.
 
The "letter" deleting KZPO had nothing to do with the "Show cause order". The FCC ALJ gave Mr. Zawila permission to sell all of the stations -- under FCC rules. KZPO will remain "on the air" and has filed a petition for recon -- with all of the exhibits to prove that the FCC or Mellon Bank had mis-placed the renewal application of KZPO. End of story.
 
For a number of years, Zawilla has had a contentious relationship with the FCC. Various fraudulent statements in applications, so the FCC alleges. Misunderstandings Zawilla calls them. More misunderstandings and problems than most licensees experience in several lifetimes. I find it particularly curious, Zawilla, himself an attorney, can have so many "misunderstandings" and problems. It's hard to tell who is at fault in this debacle. For a number of years now, the FCC has been totally screwed up and inept. I can tell you from years of personal experience, as a general statement, many of the present day FCC field inspectors are not the sharpest people I have ever met. Far from it. Given his track record, Zawilla is not beyond suspicion either. He is now blatantly operating with a CANCELLED license which is beyond amazing. Any other licensee would have a federal marshal, court order in hand, locking the place up until the situation is resolved. Wonder how this going to play out.

Yes, applications have been processed by the Mellon bank for quite some time now. I'd say 5-10 years.

Why is this station on the still air
 
KingsRadio remains "on the air" pending the out come of the license renewal application -- per FCC rules. ( 47 CFR section 1.62 ). Zawila may not be the very best radio station operator -- but he is an attorney. If KZPO was operating beyond FCC rules -- the FCC would have taken action by now. If you think otherwise -- call Mr Zawila and let him know.
