Marinello's attorney wants him out of jail today

From WWL Radio's website:

Vince Marinello's attorney says his goal today is to see his client out of jail. Chick Foret says "We are going to work on getting Mr. Marinello out."

A magistrate judge has set the bond at $250,000.

Marinello has been behind bars in the Jefferson Parish lock up since Thursday afternoon. He surrendered to authorities after detectives told him a warrant was being issued for his arrest. Marinello is charged with 2nd degree murder for the killing of his estranged wife, Mary Elizabeth Marinello.

Marinello has not confessed, and Sheriff Harry Lee says Marinello has maintained his innocence.

Lee says he believes the long time New Orleans broadcaster put on a disguise, drove to Old Metairie, pulled a bicycle from his car, rode to the 400 block of Metairie Road, shot his wife twice in face, fled on the bike, got back in the car and drove away.
 
Sorry, but I've never trusted any attorney with a "cutsie" nickname....

While I can't comment on the specifics of this case, I wonder one thing. If Sheriff Lee believes a suspect essentially stalked a victim, laid in wait, and fled the scene, how is that SECOND DEGREE?

In some states, that would be first degree, with aggravating circumstances.

Thanks for linking the statutes, RFLA. Very interesting; I have never seen a murder statute written quite like that.

Of course, I don't know too much about criminal law, and this is Louisiana, a Civil Law jurisdiction. But, again, that's kinda' odd.

But yep Louisiana is basically more in the lines with Latin America and Europe than the rest of the US when it comes to law...
 
I guess I could have looked up the statutes on Westlaw, but, that saved time and effort!

Still, Civil Law remains a bit of a mystery to me. I understand it academically, but conceptually, it's tough to grasp for one schooled in Common Law.

But, I digress...

Certainly, the facts as given fit Murder 2 as defined in the Pelican State, in this case.

I wonder when we'll see coverage of this case on Nancy or Greta, et. al. 'Seems like good fodder for those low-brow legal shows, especially now that Jon Benet is back off the radar screen.

3 nights ago I saw this story covered on ABC's overnight news program, so it's received national attention already. :eek:

Newspapers statewide have reprinted A.P.s story.

TV stations in Baton Rouge, Lafayette, Lake Charles and Alexandria have also aired reports.
