Newsmax Accuses Fox News on Antitrust allegations in a lawsuit




This is interesting because I never thought that could happen given the era we are in today.

Newsmax filed an antitrust lawsuit against Fox News, claiming that the news outlet has maintained its dominance among right-leaning cable, satellite and streaming networks via an “exclusionary scheme” to suppress competition.

The lawsuit, filed in federal court in Florida on Wednesday, also names Fox Corporation as a defendant.

Newsmax claimed that Fox “employs at least three anticompetitive means to exclude competing providers of right-leaning video content from the market.” They include “explicit or tacit” “no carry” provisions on distributors that condition access on concessions not to carry other right-leaning news channels like Newsmax.
 

This is why Newsmax is suing Fox News its tied to this streaming deal they have with Trump Media. We mentioned here previously Fox inc has other divisions besides Fox News/Fox Nation app like Fox Sports, Fox One app, Tubi and Fox Television Stations. We Mentioned here is that the Murdochs know that being too dependent on Trump will kill their operations at some point. The Murdochs know they have to attract a wide range of audiences outside of Trump supporters to have viable business model for a media company. Newsmax is too dependent on certain circumstances like elections that will boost attention to them every two years. Here are the current stock price for Newsmax and Fox Inc and yes Fox has a higher stock price than Newsmax.

There seems to be a "disconnect" between the negative EPS of Newsmax and the stock price.

IMHO: Newsmax needs to win the suit they will refile before September 11th, or start turning a profit to stay viable.
 
Glad that a judge dismissed Newsmax baseless lawsuit as it was meritless as well. FOX has other stuff than just news and Newsmax only has news that's it and I don't buy their claims that FOX tells Pay-TV where Newsmax is placed which I think Pay-TV knows that Newsmax doesn't have very good ratings, why it is on a higher package for the few that want to watch it.

Personally, that's what I thought about this last election-- I was so fed up with both candidates fighting against each other (Kamala claiming Trump is a racist and a fascist, Trump yelling that Kamala wants to keep the borders wide open); it was, shall we say, akin to two kids fighting over the last bit of cake in the fridge, each one yelling, "I want it!", then, "No, I want it!" and back and forth, until it takes one of their parents to step in and say, because you couldn't share it equally, I'm taking it and eating it all (either that, or throwing it out).

As such, IMO, neither candidate deserved the Presidency, and I was seriously considering going Independent (which is what I still might do, if there is another election come 2028).
 

Here is an update on the Newsmax lawsuit against Fox News. Yes it’s questionable given where we are now. Lawsuit is dismissed.
I'm really shocked it was dismissed so quickly. I didn't think Newsmax had a basis for their action, but these things usually drag out longer.

True too also we are in the era of TV apps and how much will content creators have to either appear on their own apps like Fox its the Fox One, Tubi and Fox Nation apps. For Newsmax its wherever they are going for viewers in apps and how long will they be dependent on Trump until its not viable to do so.
 
If they have an issue with the Judge, they could have filed in another court. There is a whole "business" of "shopping" bankruptcy courts for your clients. If you are an Airline you in the past have used the Chicago court like Delta and Northwest did. Some courts tend to keep existing management in place and protects management's "Golden Parachutes" better than others.

I wouldn't doubt there are courts that are more favorable to enforce antitrust than others. That's what you pay big time law firms to figure out..
 
It's hard to discern what Newsmax hopes to gain. Their retained counsel certainly has an interest in prolonging this ongoing litigation, but it's very unlikely that there will be any meaningful settlement or judgement in Newsmax' favor. I suspect some strategy is driving this, but it's anything but clear.

Newsmax is owned by Christopher Ruddy, a friend of the president. The president agrees with Ruddy, no matter what. So, as they say, there's no such thing as bad publicity.
