(R-I) San Jose pirate fined $25k, interfered with aviation radio

http://www.radio-info.com/news/bay-area-fm-pirate-knrg-ktriggers-complaint-from-the-faa

>>FCC agents paid four different visits to Gabriel A. Garcia of San Jose and three times found an unlicensed operation at 92.9 and then a fourth time detected a broadcast at 104.3. The case goes back a year, to March 2010, and now Garcia is issued an unusually stiff fine of $25,000. The FCC says "We find Garcia’s misconduct particularly egregious because his operation resulted in apparent interference to the FAA’s Aviation Radio Services band." The base fine for unlicensed operation is $10,000, and is adjusted this time upward to $25,000.

Bob I think you know I am a pilot, among other things, and nothing P*sses me off more than pirates with equipment that are throwing harmonics that interfere with aviation.

As you know right in our back yard not too long ago, we had a similar situation where the FCC went down to Brocton because of the same thing.

For this clown to be on his 4th offense is an affront to every pilot and passenger.

What are they waiting for 2 planes to bump into each other on the ground while taxiing?

For someone to have a controlled flight into terrain while flying IFR because the navigational beacons are being interfered with?

Pirates need to be dealt with swiftly and severely, I don't care if they are in Somalia, California, or Massachusetts.

I agree with the previous poster.

A $25K fine doesn't seem to cover the four "service calls" let alone any other costs associated with a willful and repetitive lawbreaking by this individual.

When I was working in San Jose.....these guys were on since the late 90's. Certain nights you had as many as 4 of them on transmitting frequencies 88.1 Caliente, 92.9 Energy, 93.7, 104.1. Even Pirate Cat Radio would be on doing things like playing Alfred E. Neuman's belching recording continously..I mean for several hours. They would even give out their numbers over the air....I called on my cell, acting like The FCC and they told me to try and find them. They had as much rights as anyone to be on.
These frequencies would be lit up around 6 PM and go on till midnight - 1AM. It was mostly hispanic, rap, hip hop. You would even get an ocassional pirate once in awhile broadcast like the "Station That does Not Exist" or something that sounds like a family or group of partiers getting on the air singing to the recording of Queen's "Bohemian Rhapsody". And yes Profanity in English and in Spanish. They would hang posters in the Alum Rock area posting live broadcast from some clubs or bar in the area. I don't know how much power they would use or if they were up on Mt. Hamilton...but some of those got out practically from one end of town to the other. And San Jose has some wide city limits. Being on the road at night in the area....there were times that you heard some really interesting broadcast..... replacing the basic stale corporate programming you get a night.

There was a pirate a few years ago at 104.1 that was on 24/7, until one of the radio engineers, I think John Hidgon paid a visit to them. It was posted on the ba.broadcast group while back.
