Russ Martin New Court Date 1/8/09. To be placed in Diversion Program

Requirements for entry into Tarrant County
Domestic Violence Pre-trial Diversion Program
1. Partner-to-partner violence
2. No current or prior violation of protective orders
3. No stalkers
4. No active warrants
5. No other pending charges
6. No prior diversion programs
7. Commitment to completing the 12-month program
8. Literacy skills sufficient for program participation
9. Victim approval
10. Defendant must be enrolled by the first appearance docket

Procedure for Diversion Program
1. Defendant meets above requirements and is recommended by DA to the program.
2. Takes screening test for appropriate programs at UTA - $100 fee.
3. Victim signs consent for defendant to participate.
4. Enters a plea of guilty – Judge recesses hearing for 1 year.
5. Completes programs as a condition of bond.
6. If defendant successfully completes program, hearing is reconvened, plea is withdrawn and case is dismissed.
7. Defendant is eligible to apply for an expunction 2 years after dismissal.
 
Money and a good lawyer will buy you justice. Cept if your OJ.
 
If RM takes that plea it should be enough for CBS to void his contract on a morals clause and not have to pay him. Will be interesting to see what they decide to do.
 
It'll be a good test of local justice to see if the judge/jury isnt swayed by the celebrity factor...

Didn't Russ turn down a plea bargain agreement with the Tarrant County DA because he didn't want to plead guilty?

With this he's pleading guilty, however, the "expunction 2 years after dismissal" is probably the payoff for him as it coincides with the KLLI contract end date of 2011.

Though I'm not sure laying low for 2 years will do his career any good. The old adage "out of sight (in this case, hearing), out of mind, ya know... ;)
