WDBJ faces $325K fine for showing 'graphic sexual images' on 6pm newscast in 2012

The Federal Communications Commission intends to fine WDBJ Television, Inc., Roanoke, Virginia, $325,000 for broadcasting graphic and sexually explicit material during the station’s evening newscast. The FCC’s Enforcement Bureau investigated viewers’ complaints that WDBJ aired a news report that included graphic sexual images taken from an adult film website in the report. This enforcement action would be the highest fine the Commission has ever taken for a single indecent broadcast on one station.

On the one hand (which is more important), my challenge still stands for anyone to show that the community standards authority given to the FCC applies to anything other than cable television. Because it doesn't.

On the other, you don't poke the bear and expect to get away unscathed.

Actually the FCC doesn't have any authority over "community standards" on cable. Most cable channels voluntarily stick to the same standards as broadcast TV, but they don't have to.

Looks like the FCC has the Local TV station WDBJ TV by the balls. Why did they air the porn clip? A former porn star is now on the local rescue squad.. Why would you show a porn film they did in connection with what they are doing now. It's just stupid.

Look it up in the law. "Indecency" only applies to cable. There is absolutely nothing that gives the FCC the authority to police "community standards" or "indecency" on broadcast television. That's why they want to avoid going to the Supreme Court with one of these cases, because if they do, they'll lose the ability to make money off of those fines.

You expect the FCC to be honest about their money-making scam? Look it up in the actual laws by which the Commission operates. Look for "indecency." It only shows up in one place: cable television. Not broadcast television, not radio, cable only. You won't find "community standards" anywhere.

EDIT: Actually, I may have that backwards. It may actually be "community standards" that refers to cable and "indecency" or "indecent content" that isn't referred to at all. It's been a few years since I researched it. But either way, it still only applies to cable.
