White House proposal would have FCC and FTC police alleged social media censorship

This is going to have a long debate in congress and courts though if they made and debate the law on how facebook, twitter, Gab, Bitchute and others handled.

Washington (CNN Business)A draft executive order from the White House could put the Federal Communications Commission in charge of shaping how Facebook (FB), Twitter (TWTR) and other large tech companies curate what appears on their websites, according to multiple people familiar with the matter.

The draft order, a summary of which was obtained by CNN, calls for the FCC to develop new regulations clarifying how and when the law protects social media websites when they decide to remove or suppress content on their platforms. Although still in its early stages and subject to change, the Trump administration's draft order also calls for the Federal Trade Commission to take those new policies into account when it investigates or files lawsuits against misbehaving companies.
If put into effect, the order would reflect a significant escalation by President Trump in his frequent attacks against social media companies over an alleged but unproven systemic bias against conservatives by technology platforms. And it could lead to a significant reinterpretation of a law that, its authors have insisted, was meant to give tech companies broad freedom to handle content as they see fit.
 
Ironically the Republicans eliminated the FCC from any involvement in the internet when Trump came to power two years ago. Now it seems as though they've reversed themselves. They will find that this can't be accomplished by executive order, but will need an act of Congress, because the FCC doesn't even have this authority with broadcast radio & TV stations.

The real problem is handling terms of service agreements and lawsuits made against social media companies. There is already a long court case going on now with Alex Jones.

And just a reminder, the First Amendment to the Constitution says very clearly: Congress shall make no law abridging freedom of speech.

If you look at things fairly, the government is the wrong organization to do this, because then it becomes political, depending on who is in power at the time.
 
This comes just a few days after Recep Tayyip Erdoğan (president of Turkey) mandated his equivalent of the FCC do the same thing.

If Erdoğan is making something policy, it is probably not right for the United States.
 
The interesting part of this is Republicans moved oversight of the internet from the FCC to the FTC in the Commerce Department, which is why they're included. But I don't know many Republicans who are in favor of increasing regulations. This will likely mean a budget increase for the FCC, because they'll need to hire new staff to handle this oversight. It'll be interesting to see what Rand Paul and other libertarians think about this. Where is the Constitutional basis for this new regulation?

The other thing to consider is the moderators at Twitter & Facebook aren't lawyers or politicians. Most of them are technicians who are simply following policies set by the terms of service. So it puts them in a sticky position. The other part of this that the White House doesn't want to talk about is the amount of content on these social media platforms that is coming from the Russians and Chinese that is geared towards fomenting violence and hatred in this country. So this is opening a very big can of worms.

I know, but that's why so many of his EOs have been overturned by the courts. My bet is this one will too. So he tells his base he went to bat for them, and was shot down by someone else.
 
Fair is fair .....Shocked that one sided CNN picked up the story...Its about freaking time and the credit goes to " AJ " for getting it started a year ago.Hats off to him for doing so..All its been is one sided left wing with the social media biz and MSM and China's Hollywierd with their rubbish narratives .Gave up on Hollywood years ago....For once we get an conservative insider in the WH and the swamp are not happy campers with him in there .Clownworld has started .Sorry to say it looks like a rerun 2016 in 2020...

AJ probably going to win it.Like your point in your last sentence . I can see if the tables were turned the opposite way .This will be going on too...My issue is nobody is forced to tune in any radio or TV show if they dont like what they are hearing.....Shut it off or tune in another station.....

They are also not forced to use social media. I know a lot of people who don't. If conservatives don't like Twitter or Facebook, there's no law preventing them from starting their own site. And blocking all the liberals they don't like. That's the thing about the internet...it's a-political. It's non-partisan until people use it.

One other point: If any of the demonstrators threatening McConnell had stepped on his property, they could have been arrested, and even shot in self defense. There is no freedom of speech if you go on someone's private property. And social media platforms are private property. They are private clubs, and when you sign up, you agree to follow their terms of service. Everyone checks that box in order to use the platform. Either you follow the rules or you don't. That's what this is about. If you don't want to follow the rules, the owner of the site has the right to ban you.

Yes and you gotta consider congress though can overturn the EO's through debates, hearings and votes when it comes to the FCC and social media.
 
Consider how the FCC's indecency rules have been treated by the courts. The two words "arbitrary and capricious" come to mind.
 
i think this may be a fight that will end with the judgment on whether or not it violates the constitution as this would fall under the 1st admendment. this is gonna be a nasty fight.

i would say more, but i'm not trying to get banned on here for politics reasons.
 
So the White House is floating this idea to have the FCC and FTC oversee social media.

I can say from personal experience that Washington is not that big a place. The White House isn't that far from either of these agencies. How is it that they don't talk to each other? That was not a problem in previous administrations.
 
All I'm gonna say is Trump will have his hands ALL OVER this

As for the "Dysfunction" in Congress, there's a reason for that & it has a name - Mitch McConnell

It's THE SENATE who can't turnover little red wagons , NOT Congress...
