NCE HD channels & commercials

I was curious if there are any examples or regulations regarding a NCE with HD capability allowing the leasing or programming of their HD2 by a commercial entity, for instance, a commercial operator leasing the HD2 to feed a translator with a commercial format - is this forbidden by current regulations?

If the frequency is in the non-commercial band (88.1 - 91.9 FM), then it's not allowed for a commercial operator to operate any station as a commercial station. A traditional commercial operator would have to be creative at doing underwriting (technically commercials in my opinion, but done differently), in order to be able to lease out an HD-2 channel. Most commercial operators won't even try to seek broadcasting on an HD-2 channel in the non-commercial band, just to feed an analog translator. Now in Chicago, 98.7 WFMT is a commercial licensed station, but choose to operate as a non-commercial, & could lease out an HD-2 channel, if they choose to do so (if they're broadcasting in HD).
