CNN Facing Large Racial Discrimination Lawsuit

While the problems at Fox News have captured far more attention, CNN has some serious legal troubles of its own. If this plays out and gets legs, and the Time Warner merger with AT&T proceeds it may lead to significant changes at CNN. Clearly there are some problems in Atlanta!
 
The Fox problems have captured more attention primarily because they dealt with top on-air talent and the Chairman of the company. Not the case at CNN.

This is true but in the end CNN will probably have pay out more than what Fox ever has, at last check close to two hundred people have joined the class action lawsuit.

The NY Times reported that AT&T was told it would have to sell CNN or DirecTV.

The logic is that with Time Warner + DirecTV + Uverse AT&T will control a massive share of cable distribution.And if they therefore own a news channel they could potentially throw anti-competitive tacks in the road for competitors like Fox News and MSNBC.

Actually if AT&T has that much power over cable distribution the deal is very bad for consumers and should be blocked IMHO.

They're about to shut down Uverse. It's been a total disaster.

I think if you compare it to Comcast Universal NBC, it's not too different.

Update on the CNN Lawsuit

A federal judge in Atlanta this week dismissed a racial discrimination case filed by a CNN employee.

DeWayne Walker, an Atlanta-based manager of integrated marketing at CNN, originally filed his lawsuit more than two years ago. He claimed that he was passed over for jobs he felt he was qualified for because of his race.

Magistrate judge Catherine Salinas ruled that of the nine positions Walker claimed were not made available to him, he was not eligible for seven of them. Another position he didn’t actually apply for. “He has not argued that it would have been futile for him to apply,” she wrote. “As a result, Defendants are entitled to summary judgment on this failure-to-promote claim.”

In the one position he did apply for, the white employee they did hire was demonstrably qualified and she could not find evidence that race was a factor.

“Plaintiff attempted to establish pretext by arguing that he was ‘substantially
better’ than Mr. [Stephen] Krill,” Salinas wrote, “but given the undisputed evidence of Mr. Krill’s qualifications for the position, Plaintiffs evidence is insufficient to defeat Defendants’ Motion for Summary Judgment.”

Now other divisions of Time Warner like TBS are facing similar lawsuits of racial discrimination.

TBS employee Wanda Byrd in a case filed in the United States District Court of the Northern District of Georgia on January 18.

Other defendants are Time Warner, CNN and Turner Services.

The basic gist of the lawsuit is that African-American mid-level managers at TBS have a significantly more difficult time moving up the ranks compared to white ones. This is a similar basis for the class-action suit filed in 2016 which featured plaintiffs Celeslie Henley, a former executive administrative assistant at CNN, and Ernest Colbert Jr., a senior manager at TBS.

The lawsuit blamed a performance evaluation system which provides white managers “undue authority to make biased and inconsistent determinations with little or no oversight and/or feedback. The system permits discrimination on the basis of race in evaluations, where raises, bonuses as well as further advancement within the Company, are based.”

It also alleges, based on data provided by TBS, that blacks at comparable jobs to whites get paid significantly less. The suit also claims it takes three times longer for a black employee to receive any kind of promotion vs. a white employee. It also says very few black employees at TBS ever reach senior levels.

Time WArner doesn't own any cable anymore. Time Warner Cable was sold to Charter and rebranded to Spectrum.
