K258BZ on 99.5 just had it's application to modify their license dismissed.
The staff has under consideration: (1) the above captioned application; (2) the Petition to Deny filed by Gow Media, LLC on December 23, 2020; (3) all related pleadings. For the reasons set forth herein, we grant the Petition to Deny and dismiss the application File# 124943.
Gow Media, LLC, licensee of KFNC(FM), Mont Belvieu, Texas, filed a Petition to Deny stating that the proposed translator application for K258BZ on channel 247 will cause interference to listeners of KFNC(FM). Gow Media, LLC states that this proposed facility is in violation of Section 74.1204(f). In order to provide convincing evidence under Section 74.1204(f) that grant of the translator construction permit “will result in interference to the reception” of an existing full-service station, an opponent must provide, at a minimum: (1) the required number of listener complaints; (2) map showing the specific location of the alleged interference; (3) statement that the complaining station is operating within its license parameters; (4) the complaining station has tried to inform the translator licensee and attempted to resolve the alleged interference; and (5) U/D data demonstration that the listeners are within the area predicted to receive interference. The petitioner has submitted all the required documentation from over 25 listeners that certified and are listeners of KFNC(FM) and live, work or travel within the predicted interference area of proposed translator.
Accordingly, the Petition to Deny filed on December 23, 2020 by Gow Media, LLC IS HEREBY GRANTED and the application File# 124943 IS HEREBY DISMISSED. These actions is taken pursuant to 47 C.F.R. § 0.283.
