A $16,500 fine has been proposed against Shelby Broadcast Associates’ 98.3 W252BE Tarrant AL following petitions to deny against its license renewal and proposed 2020 sale to Riviera Communications for willfully and repeatedly operating the translator at variance from its license without authorization, willfully failing to timely file for special temporary authorization, and willfully failing to disclose material information regarding such unauthorized operation.

The FCC notes that W252BE has operated with parameters at variance from its authorization since November 8, 2015 which have been unauthorized since its STA expired on November 19, 2016. Another STA was filed for in 2018 with Shelby later admitting that both STAs were filed with “inaccurate technical information” as it was operating with an incorrect antenna height. Shelby also certified in its renewal application that “there had been no violations by the licensee” during its previous term.

2 questions I ask now:

1. Is a LPFM radio broadcaster, like me, allowed to discuss this on here?
2. If this relay is forced off the air, will Mr. Lee Perryman be able to upgrade his WSGN 98.3 FM signal from the Sylacauga area?

This inquiring mind wants to know.

Doubtful that WSGN-FM would be able to move any further north and west than it already is, at least on 98.3 FM. So whether the W252BE license is canceled or not, it won't help WSGN-FM that much as far as getting a listenable signal into the Birmingham metro. If the W252BE license were to be canceled and taken off the air, WSGN might gain some semblance of a signal in Jefferson county where W252BE's signal takes precedence (by "precedence", I mean as far as what listeners in Birmingham and Jefferson county are more likely to receive as far as a signal on 98.3 FM). WSGN still won't be broadcasting from the "Suburbs of the Magic City" either as I've heard them tout following their hourly station ID. Their transmitter is SE of the city of license of Stewartville, and Stewartville is NOT a suburb of Birmingham.
