Can Applicant Change COL ,Frequency, Power & Move 35 Miles Away?

Recently an applicant for a noncommercial FM station during the last window found themselves in an MX so they amended their application to move to a new city of license 35 miles from the original app city, change frequency, change power, change antenna site to withdrew from the MX. Isn't that like filing for a new CP outside of a window? Any observations?

As long as there is mutual exclusivity between the old and new site, it is OK. This is encouraged as a way to break out of an MX Group and create more singletons.

When you say mutual exclusively between the old and new site does that mean the applicant for the old site can get a cp and the applicant for the new site can also get a cp for the new site ?

Thanks for clarifying an issue in an area where many of us... self included... are woefully ignorant!
 
Here's a recent amendment. This may be the one you are alluding to. In this case, they move a significant distance, do a first-adjacent channel change and a different community of license. Since there is overlap between at least once contour, the two proposals are mutually exclusive with each other, it is minor:
