KPCR Pirate Cat Radio - Los Gatos

One has to wonder if her perjured himself on the application. If the FCC didn't know or only sent a letter he responded to assuring he ceased transmission and is to get rid of the equipment you can generally be okay. This newspaper article admitting pirating brings up contesting the license. At least he did it the 'right way' by applying for a LPFM.
 
He is not listed as an officer of the company or the non profit at this point, though he was listed as the one incorporating the organization. on the fcc paperwork, he shows up as "station paperwork representative".. so he didnt have to lie or admit to the truth, since hes not an officer or director of the organization.

Orinda's just on the other side of the East Bay Hills from Oakland. I wouldn't consider either to be local to Los Gatos.

The Calcot Place address was something of an industrial area nestled between 880 and 23rd Avenue. I'm surprised there are apartments there - unless it's some sort of private mailbox instead, but those are supposed to be designated as "PMB".

Santa Maria is in between San Luis Obispo and Santa Barbara off Hwy 101, so not in or near the SFBA. And Linda G. Roberts is, according to Spokeo, 88 years old, so she's more likely to be Daniel's mother or (even more likely) grandmother or aunt. Spokeo also says Ms. Lossing is in Moraga, an adjacent community to Orinda. And that Mr. Briery now resides in San Fran, not Oakland. I can't guarantee any of that, but Spokeo is generally reliable.
 
92.9 had different pirate operators years ago. I remember being able to hear techno/dance music on that frequency in 2002/03 in the part of San Jose I grew up in, even though the Mercury News Eye section never listed that station. The pirate was not shy about it, even putting up POSTERS in some places.

In 2011, the 92.9 pirate got fined $25,000 for "apparent interference to the FAA’s Aviation Radio Services band" and following "multiple notices and warnings issued by the San Francisco [FCC] Office".

I guess this thread has been waiting over a year for my answer. I am sorry I am just a little bit late to the party.

Where it comes to LPFM and pirate radio, Sec. 73.854 of the rules states:
No application for an LPFM station may be granted unless the applicant certifies, under penalty of perjury, that neither the applicant, nor any party to the application, has engaged in any manner including individually or with persons, groups, organizations or other entities, in the unlicensed operation of any station in violation of Section 301 of the Communications Act of 1934, as amended, 47 U.S.C. 301. If an application is dismissed pursuant to this section, the applicant is precluded from seeking nunc pro tunc reinstatement of the application and/or changing its directors to resolve the basic qualification issues.

This is an interpretation of Section 632 of the Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies Appropriations Act, 2001 (Public Law 106-553; 114 Stat. 2762A-111), which was first created in 2000 in the Radio Broadcast Preservation Act, but was upheld in the Local Community Radio Act, which states in paragraph (a):
(a) The Federal Communications Commission shall modify the rules authorizing the operation of low-power FM radio stations, as proposed in MM Docket No. 99-25, to--
(1) prescribe protection for co-channels and first- and second-adjacent channels; and
(2) prohibit any applicant from obtaining a low-power FM license if the applicant has engaged in any manner in the unlicensed operation of any station in violation of section 301 of the Communications Act of 1934 (47 U.S.C. 301).

Now with that said, for applications for new LPFM stations (in this case, it would have been 2013), there is a certification question for original construction permit stating that any party to the application has in the past engaged in unlicensed operation.

While the applicant at the time certified that they met this requirement, it is important to realize who the applicant was in 2013. It was an organization called Media Watch and had three board members: Katherine Herndon, Gael Roziare and Jill Ginghofer.

In 2019, the station's license was assigned to Central Coast Media Education Foundation. The board members were Linda Roberts and Heidi Lucas.

Unlike the application for an original construction permit, the assignment application does not require certification of the unlicensed broadcasting rule.

So not that it matters in this case then, but I'm curious -- would an applicant have to disclose that they engaged in unlicensed operation of a station if it only occurred when they were a minor? The rules you quoted don't make any mention of that, but in general aren't there protections for minors that would preclude someone from having to disclose something they did under age 18?

I'm not asking for myself, lol. I thought of it because the article stated Mr. Roberts was a teenager when he ran those broadcasts from his bedroom.
 
K225CK (92.9 FM, Union City) has been off the air for over a year, despite filings to the FCC stating otherwise.

Here’s what’s been discovered:

Station was silent: Multiple monitoring attempts between Nov 2023 and March 2024 showed no signal. Just static or distant KPCR-LP from Los Gatos.

Transmitter removed: Site owner Joe Fereira confirmed he disconnected and removed all K225CK equipment in Oct 2023 due to nonpayment.

False filings?: Radio Punjab filed a Silent STA in Sept 2024 citing KMKY(AM)'s silence as the reason — but KMKY didn't go silent until March 2024. That’s a 6-month discrepancy.

Bogus resumption?: In March 2025, they claimed the translator resumed operations. But the site still had no equipment until June 2025.

Current broadcast unauthorized?: As of June 2025, they reactivated the signal without a lease or payment. Fereira says: “They’re kind of breaking the law right now... That shouldn’t be on.”

This raises major questions:

Did Radio Punjab lie about when they went silent?

Did they falsely claim resumption to avoid license expiration under 47 USC § 312(g)?

The FCC has been notified. If you’ve noticed similar behavior from Radio Punjab or experienced interference on 92.9 FM, speak up.
