Miami/Fort Lauderdale "Radio Touche ******" pirate challenges FCC fine

Fabrice Polynice, operator of the pirate station on 90.1 since at least 2012 is now trying to get the multi-million fine against him rescinded as unconstitutional.

Of course, in Kreyol "Touche Douce" literally means "soft touch" or "smooth touch". A stuffed animal has touche douce, but it is more of a romantic mood reference. Not "smooth" as in slow jams... "smooth" as in "kool" or "dope" or "da bomb" or "fresh".
 
If he can’t or doesn’t pay the fine and the FCC doesn’t reconsider it, then could he face jail time via the DOJ?
It would appear that there are steps in between, such as the FCC challenging his interference as a safety issue. There is no "debtor prison" in the US, so not paying the fine won't put him away. But they can get him for a variety of other violations.

I am reminded that the feds got Al Capone not for his organized crime activity, but for tax evasion.
