New Orleans La Calle 97.9 Fined for originating programming

FC New Orleans Inc’s “La Calle 97.9” K250BA New Orleans LA has entered a consent decree with a $4000 fine for originating programming. An FCC agent first noted the translator originating programming in January 2020 when then parent signal 104.1 KVDU-HD2 Houma was off the air with a Notice of Violation issued in February 2020. KVDU went silent in August 2021 after its tower was destroyed by Hurricane Ida, although the translator kept originating programming until at least April 2022 when it began leasing 640 KTIB Thibodaux to feed programming.

For a tiny station that has to have very limited revenues, that could be a very significant amount.

KVDU-FM is owned by IHeart Media and that's no small company. That said, I don't know who actually owns the HD2 signal and if the same person or group also owns the translator.

And that leads to a question. If one company owns the main HD1 signal and another owns the HD2 signal and translator, then is the company holding the HD1 signal assumed to be in any way liable if the translator for its HD2 channel continues to run programming after the HD2 channel is forced off of the air? Likewise, if the owner of the HD2 channel and the owner of the translator are different people/corporations, then is the owner of the HD2 channel held liable for the owner of the translator continuing to provide programming to that translator after the HD2 channel has been forced off of the air?

The "station" fined is K250BA. That is an independent company which has a translator that rented an SCA from iHeart to allow the translator to operate. iHeart has noting to do with the translator. HD signals are owned by the concession holder of the underlying FM station license.

Only the licensee of the FM station that operates HD channels holds the license. But in many cases, HD channels are rented by third parties to run as an independent service or as the enabling program service for a translator.
Likewise, if the owner of the HD2 channel and the owner of the translator are different people/corporations, then is the owner of the HD2 channel held liable for the owner of the translator continuing to provide programming to that translator after the HD2 channel has been forced off of the air?
The owner of the FM station that rents out one of its HD 2 and beyond channels is only responsible for what is on the HD channel.
 
And as in this case, I heart leased the HD2 slot of 104.1 when it was in Vacherie, but the station was still originating when 104.1 had issues, and when the tower fell, they couldn't prove they were on air in HD and rushed within days of if i remember of a expiring STA to originate programming on KTIB, who turned off (and later sold) its translator, and flipped to become originating station of La Calle.

La Calle is advertised more to the Central American Latino community if i remember , wheras Latino mix is aimed at young Latinos, y tropical 105.7 if i remember is more Carribean and talk.

@davideduardo can correct me if I'm wrong on my take of the formats as im not as swift on spanish language radio as he is, but im figuring with spot load I hear, they are doing half decent (plus you figure what ever the lease is to KTIB)

KVDU has been in Baton Rouge for almost a year now. Also I got me an HD Radio last month. 104.1 is broadcasting on HD and last time I checked there don’t have HD2 on 104.1 currently. If they did have one I would assume they would put something to compete with 94.1. But that’s probably going too much off topic lol
