Apparently, yes. However, it was granted authority to remain silent about a month ago. So, unless it files for another STA, it will have to be on the air by early March.

Here's what KAVD's FCC request to remain silent stated:

Description: JUSTIFICATION

KAVD WAS TAKEN OFF THE AIR ON NOVEMBER 3, 2005, IN CONNECTION WITH THE RELOCATION OF KJEB(FM) FROM STRASBURG TO GREENWOOD VILLAGE, COLORADO. KAVD HAD BEEN SIMULCASTING WITH KJEB. KJEB'S RELOCATION ELIMINATES IT AS A PROGRAM SOURCE FOR KAVD. COLORADIO, INC. IS IN THE PROCESS OF ARRANGING A NEW MAIN STUDIO LOCATION AND AN ALTERNATIVE PROGRAM SOURCE FOR KAVD AND WILL NOTIFY THE FCC WHEN KAVD RESUMES BROADCAST OPERATIONS. COLORADIO, INC. REQUESTS A SILENT STA FOR A 90 DAY PERIOD.

As far as the transmitter site/city of license change from Limon to Parker, KAVD's last application is being opposed by Jacor/Clear Channel - as it proposes downgrading KRFX's channel classification from a full C signal to a C0 - which wouldn't change KRFX's present technical parameters - but will limit KRFX's ability to upgrade in the future.

KRFX (along with KMGG and KBPI), applied for upgraded facilities in 2003, but those applications were denied in 2004 after the FCC decided that it would no longer accept what is known as a "Denver Waiver", which it routinely granted in the past.

Basically it all about the way HAAT is determined for Denver FMs on Lookout Mountain. Jacor/Clear Channel is apparently appealing that decision.

Had KRFX been successful in its 2003 application, KAVD would have had more stringent site restrictions in place for its Parker signal and would have to protect KRFX to a larger degree.

But since KRFX's upgrade was denied by the FCC, KAVD is now attempting to reclassify KRFX as a C0, which apparently reflects KRFX's current technical parameters. My guess is if KAVD is successful, KRFX's appeal for its facility upgrade is moot.

It really depends what program source they can find (through simulcasting or otherwise) to stick on the signal until they complete their move from Limon to Parker (see my post above).

Its not about a competitive format; its about having some programming - anything - to keep the signal active while work their way through the move.
