93.3/L1 Collierville

So, as most probably know, a group was granted an L1 station (100w @ 100') for Collierville some time ago. Reading the application, the station promised to program Catholic programming from its tower near The Historic Square.

I just popped up the FCC data, and it appears that the CP expired -- or should have -- on August 14th. No calls were ever applied for, and it does not appear any modifications were requested. It may be, though, that something is sitting in the jacket at the Commission that ain't showing on-line. 'Can't be sure.

Very odd. Signing on an LPFM -- especially one that will operated much off the Bird -- just ain't that hard, or expensive. Heck, between me and a couple specific folks on this Board, the thing could be on inside a week. All that's really needed is an off-the-shelf antenna (or even a homemade J-Pole, if the FCC allows -- about $40 worth of parts at Lowe's), a solid state transmitter (a few thousand dollars, max), and some hardline, easily found on Ebay. I wonder what the problem is.

If the CP holder has evaporated, there is a frequency in Collierville waiting for an applicant. NEXT!

I spoke to the gentlemen who controlled this CP. While he was willing to transfer the CP to someone else, he insisted that the station be Catholic. Thus, the CP expired, and this LPFM will not be built.
 
I thought, that, in thje sale or transfer of a license/CP it was against the law to dictate what the format would be?
 
That's not exactly correct, Paul.

One can dictate anything they like. But, you're right in that the ultimate programming decision lies with the license holder. Therefore, injunctive relief would never be granted; the previous holder is not capable of MAKING you program anything. But, that does not mean that damages in contract might not be awarded.

Now, how one would figure money damages, I couldn't tell you. Even a Liquidated Damages clause might be tough here. I wouldn't want to have to write that contract.

But, and this is important, an LPFM license is virtually non-transferable. Only "less than ... substantial change" in ownership are allowed. 47 CFR sec. 73.865(a).

So, if someone wants to operate an LPFM in Collierville, work up an application...

Thing is, you can only file during a declared filing window. They haven't gotten around to opening the *first* window for LP10 stations yet, I have my doubts we're going to see a second window for LP100 in my lifetime.....
 
Somewhat related to all this, I've been wondering what's become of the Spanish religious LP in Cordova on 106.7. It was built and on thea ir back early in the summer I guess it was, had a pretty good signal for what it was, but they could never get the audio right. It disappeared after a couple of weeks and I haven't heard a peep out of it since. Do they get longer before they have to put up or shut up once the application is actually built out than they do to build it?
 
I could be wrong, but I think LPFMs, once the CP is granted... have 18 months to build and get on air.

it did have a nice signal for its HAAT & ERP indeed... I though lpfm's had to be at least 10 miles for the COL or something like that

the tx is on the other side of millington from cordova
