I have a question...does clear channel own the intellectual property to the "WILD" format? If so, how is Magic going to get away with programming kday as a wild type station. I believe that the name wild935.com was already registered to roy laughlin..thoughts anyone...

Companies can register names and service marks, like "Kiss" or "American Top 40" or "Hot Hits" but a format would be very hard to register unless you could prove you are doing something so uniquely it can be copyrighted, such as a Harry Potter book.

Roy did purchase the name three years ago, on Aug 17, 2004 and has extended ownership rights through Aug 17, 2009.

I think you mean he purchased a domain. Service marks are registered, not purchased. And whoever owns the mark can even sue to stop usage of a website name.

Well Dave, I guess you are right in your suggestion that I was technically incorrect when I said that Roy "...purchased the name...", and no I technically didn't mean that "....he purchased a domain." To be exactly specific, as seems to be so important to you, what I should have said is that Roy purchased the right to use the domain through 2009. One does not really "own" a domain, in as such, no broadcaster owns the air or frequency they broadcast on. Both are intangeble and rights to use that location (website or frequency) are granted by a governing body.

When DJDan stated "I believe that the name Wild 935.com was already registered to roy laughlin", perhaps you thought he meant that the name was service marked. I took DJ's comment to mean he wasn't certain, but thought Roy had registered the name with a domain company. I responded to verify that Roy had indeed paid money for the web location "Wild935.com".

Now, in an effort to get this thread back on subject, DJ asked about CC owning intelectual property for the Wild format. There are a few Wild's around the country - WILD 94.9 in SF (KYLD) - is owned by CC, but others, such as WILD 97.7 (WILD) near Boston are owned by other companies, such as Radio One and don't pay CC a dime.

Actually, frequencies are granted by a government, while domains are regisatered with a registrar for a fee for the purpose of controlling name usage. Often, if a name is used for a domain and the name is copy or service marked, the owner of the mark can stop usage if the registration is inside the jurisdiction of the mark registration.

Clear now owns the mark, but had to accept prior usage in a few cases... Boston does not own the name, they have a consent to continue to use it. EMF owns the name K-Love, but KLVE in LA had prior usage and continues to use it.

Geez, this is getting boring. Yes, as I said, both frequencies and domain names (addresses) have a governing body. Dave, I'm sure you know that ICANN (Internet Corporation for Assigned Names and Numbers) is the governing body who all registrars coordinate with.
