95 Triple X in the Big Apple

I happened to catch a few minutes of Elvis Duran on Z100 this morning. Imagine my surprise when I heard audio from the Mike and Sean Paul morning show (as Elvis called it). Apparently, 95 Triple X has been recording the "phone taps" from Z100, and rebroadcasting the audio themselves.

My question about this is what are the legalities surrounding this? After all, I can't imagine that CC is being compensated for use of their intellectual property. Does anybody else know of anything like this happening in radio? Is there any legal precedent here?

Both stations are probably buying these bits from a service.

If they did, I don't think Elvis would say on the radio that "this station in Burlington copies us." There's probably a reason why he's talking about this on the show.

They have turned this into a bit on the Z Morning Zoo. If you listen closely you can tell that they are putting on their lack of knowledge. They refer to the station by a different name each time(they once called them B95) but they always get the call letters correct. After ranting for a few minutes they always take some phone calls from listeners who continue the rant. From the listener's end, it is a very successful bit.

Here is your definitive answer to your questions.
1. We are well aware of the shows real name and call letters. There is no lack of knowledge. Thanks
2. The bits in question are our Phone Taps (Phone scams) that we do for REAL! In house. We do not syndicate them
3. Many of them are being recorded, transcribed and re-voiced by the aforementioned station. They even re-recorded our Phone Tap stager and closer tag lines. In fact, most of their show is a copy of ours down to their banchmarks, benchmark times and their web site which copied our old one in color and layout
4. Yes, it has becaome a very succesful bit to point this out to our listeners on occasion. We even had one of their Phone Scam actors call in and tell us how they were recruited in a mall to act out a phone call.

And leave it to a NON New Yorker to thinks it's okay to have people think you're wrong (or ignorant) and not point out that you're not, then post incorrect comments about a show that was deliberelty saying the station name wrong to show we don't care that much about them. Ha ha...nobody disrespects the Z, bro. We know that you guys know what's up. I didn't think you'd respond to that. I'm surprised to see that kind of insecurity from somebody who works at the Z.

i am not shocked if xxx was ripping stuff off from z... all ben hamilton wants is to be like z... as pointed out earlier website, benchmarks, etc. before z started streaming again (about 3 years ago) i know for a fact ben paid someone to privatly stream z to him for "ideas" was his exact words. xxx is a hell of a station, but essentially a clone of z100 nyc.

Not out of the ordinary in this industry. Who on this board, that actually works or has worked in this industry, has NOT borrowed an idea from another station?

At least they are out of market! At one point in time there was a station there that "seemed" to borrow a lot of stuff from another station IN THAT MARKET(Burlington, I mean)!

There is a big diference thought between borrowing ideas and stealing and re-voicing and re-recording...they are doing a Cover Version of Z

I whole-heartedly agree. Hearing a bit somewhere, taking the premise, and making it your own is one thing. Say I hear a guy doing a bit about subject and I say, "Hey, that's a funny subject I haven't thought of." Then I write a bit. That's fine. Plagerizing is totally different.

Maybe you don't know this "Comedy" but this board is filled with WXXX apologists.

WXXX is a station that has clearly ripped off Z100 for years. Copying imaging etc. of a station like Z100 happens all the time. I'm sure there are a hundred Z100's out there.

But honestly, come on. If all this is true, those bits are someone's actual work plagerized. That is never exceptable.

This should be an industry of creative people. As a creative person that cares deeply about radio and my performance on it, I wouldn't ever dream of doing what they are supposedly doing. They should be ashamed.
 
The million-dollar questions

1) Is 92.1 Kiss FM aware that their primary competitor is beating them by stealing intellectual property from their parent company's station?

2) If so, has Kiss made any effort to combat this? I can't hear the station in Boston, but their website indicates that they have no morning show. What's stopping them from syndicating Elvis Duran and the Z Morning Zoo? Can you field this one, Comedy?

If not a full syndication (the show, while excellent, might be too New York-centric to appeal to other markets), perhaps Kiss could broadcast the Z100 Phone Taps the same day. They're obviously a popular feature. I'm surprised to see CC not pooling its resources like this.

Well, they may not have been aware until reading this board (CC Burlington Employees do) but they are now.

I couldn't imagine that they were unaware in the first place. Triple X has been doing this for quite a while. At some point, word's gotta trickle down from New York to Burlington. It's a small biz.

Then again, Kiss thinks that "St. Albans" and "holidays" have apostrophes in them (according to their homepage), so I really can't overestimate their intelligence. I guess spelling isn't a part of that college degree that you need to work in radio now, as another thread on this board suggests.<P ID="edit"><FONT class="small">Edited by MassMusicMan on 11/17/05 09:04 PM.</FONT></P>

I would rather not give too much away..but if I am reading this board...I must know someone in VT, no? As for sharing the Phone Taps...am I getting $$$? And no, syndicating our NY show probably wouldn't be a direct hit in VT..but you never know. Our show seems to have been on XXX for some time now!! :)
