99X gets cease and desist order for billboard

WNNX (99X)/Atlanta GM Mark Renier got an interesting gift over the holidays - a cease and desist order. Lawyers from Brand Atlanta were upset with the station's parody billboard of the company's red and white ATL logo, a symbol seen all over the metro area. The billboard for the station's morning show, Toucher, Jimmy and Leslie, reads "TJLanta - Making Bad Ideas Ours, Toucher, Jimmy and Leslie 99X Alternative."

The billboard, the brainchild of 99X intern, Deborah Cantu, has since been taken down, but members of the morning show contend that Brand Atlanta doesn't have any legal grounds to have forced the sign down. Will it make a re-appearance, possibly after the station makes the transition to new ownership (Cumulus)? Stay tuned. <P ID="signature">______________

I find it interesting that interns are creating billboards at 99X. I sure hope they don't pay their Marketing Director very much.

I'm pretty sure 'parody' is a protected form of free speech.

Radio lives off of it.

Parody itself is legal. They can do all the parody they want on the air. But the way this was explained to me by someone actually involved in this case was that 99X was using the copyrighted logo in an ad, which a billboard is. In other words, the station was using a copywrited logo for (ultimately) financial gain, in terms of more listeners translating into more revenue.

Now this is not to say that the real reason for wanting the billboard down is that Brand Atlanta didn't like it. But those were the legal grounds according to what I was told.

I'm going to say that Brand Atlanta is embarassed by everything they created...ergo they don't want to see it anywhere.

Hell, after spending as much as they did for what it is...I wouldn't want to be reminded of it either.

OH, so that is what that logo I have been seeing on billboards and buses is. I new the new slogan, song and branding had come out, but the only thing I had heard is a clip of the song on Q100 (shows you how long the media coverage lasted).

See, the parody worked! It drew my attention for 1 minute to a bad idea. Anyway, I think we all have bigger fish to fry, like to either play Russian Roulette or put 97.1 back into our car stereo presets before they change formats again? Hmmm.....

Yeah it would take a lot more than a billboard to get more people to listen to their show, like maybe a threat that they were gonna kill me and even then it would take me a few minutes to decide.<P ID="signature">______________

Ahh...the tried and true formula. Several days of people discussing the goings on at 99X, followed by you saying that no one listens. For someone who claims to be disinterested in it, 99X sure has a nice big rent free space in your head.

So why the axe to grind? Did Toucher hurt your feelings? Did Steve not play a song request?
