No doubt the system is flawed. But this story is 7 years old.. In the age of the internet, that's like written on papyrus. Systems like SoundScan and such now monitor the web streams for plays and count plays 24/7. They count video plays on YouTube and other registered sites, which has their own royalty deal. iTunes, Spotify, Pandora, iHeartRadio and others weren't even around or were in infancy.

In the story, the author writes about restaurant owners getting sued for playing ASCAP tunes without a license. Today, they take college kids to court for torrent file sharing! But the premise is the same.

SounsScan has a registry for artists that it has been looking for to PAY royalties for years. Like Dino & The Diplomats on Laurie Records, The Velvetones for "Glory Of Love"...Robert DiNero used their song in Goodfellas, A Bronx Tale, and Casino. It was reissued on each CD soundtrack. They got paid for evry theatre showing, TV showing, Cable showing, CD reissue, and can't find them. The money is in escrow.

Still amazing that radio stations have to PAY to play an artists recordings, without radio playing these recordings, the public would not hear them, and thus purchase them.But...record stores, who play these recordings while you are shopping,some even have a little station set up to hear cuts from various CD's, are exempt. Why? because they provide revenue for BMI, ASCAP etc. There is really no difference between a record store or radio station. A record store plays cuts from the various recordings which inspires the public to purchase these recordings, a radio station ALSO plays these recordings which also inspires the public to go out and purchase these recordings. So why should one be exempt and not the other? isn't it the goal of both radio and record stores to get the public to purchase these recordings? To add insult to injury, it isn't good enough to collect revenue from radio stations, no, they also want to collect royalties again, from the same station,for playing the same cuts, if they stream over the internet.
