Barry Diller might be able to get the domain. The problem lies in the fact that the purpose of the site is very close, if not identical to the service Aero provides, which is owned by Barry Diller.
For instance, Madonna was able to get the rights to Madonna.Com because the guy was implying that Madonna had something to do with his porn website by that name. ICAnN who handles disputes and the courts said, that had the guy who owned Madonna.com just used it for a porn site or a religious site or just left it blank it would be one thing, but he was actively trying to deceive people into believing Madonna, the singer, was connected to his site, though he had a disclaimer on the site.
Whether on not you are successful in stopping or wresting a domain name from someone seems to rely on the confusion factor. Would the average person be confused? And if so, would this cause a loss to his/her business, either money or reputation or through goodwill?
I would think it would, because it's far too close
