The more I read about the Ward case, the scarier it becomes.

The Feds VIOLATED the 4th Amendment - by seizing the computer of Bernie Ward and his family.

Plain and simple.

I don't care about whether it was child or adult porn anymore and I don't care about the controversial soliciting funds issue anymore.

Bernie should hold a fund raiser, and fight the feds over the violation of the 4th Amendment.

This was a clear violation of the Constitutional Rights of the Bernie Ward family.

Again, surprised to see this not brought up on the forums, but nobody ever reads the Constitution in the radio business except Thom Hartmann.

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
 
where have you been? the constitution doesn't exist anymore! unless we take our country back we will soon be part of the north american union with the amero as standard curency! guess i'll go listen to alex jones to see who's rights the government violated today!

OF course it was UNREASONABLE. He downloaded something that he shouldn't have. Until I receive an alternative explanation, the best I can come up with is that the Government was spying on Bernie's computers in 2003 (and, probably yours and mine, too). Does someone have an alternative explanation for why it was a "..REASONABLE search and seizure"?

I'm following the story, and I've read that he sent a file to a woman in Oakdale and she contacted the police or the FBI (I forget which). So, it appears that the feds weren't spying on Bernie prior to the complaint. Since the statute is on the books, it is not unreasonable for the government to seize his computer. I'm surprised the challenge is being brought up, unless there are aspects of the story that haven't been made public. I suspect that there is a lot in this story that hasn't been made public.

Bernie Ward never wrote anything other than a opinion piece on KGO's website or in their newsletter "off Mike"..so for him to say "he was working on a book" IS SILLY. He never wrote a book before (unlike Savage-Weiner who wrote all kinds of health books) so the first book he decides to write deals with kiddie porn?? yeah right.

He's not following the M.O. of any kiddie porn lover that I've ever heard of. He didn't have anything on his computer. He had a few images. People who look at porn collect thousands of images and actively trade them. This has been brought up consistently in every single kiddle porn case I've ever heard about. The usual case is that some guy gets caught spying on a kid or something, the police search his home and find that there are 10,000 photos on his computer, magazines in his closet, videos on his VCR, etc. None of this has happened with Bernie. I've read the actual indictment and it's a simple one-pager that vaguely talks a couple images. BFD.

On December 6, 2007, Ward was indicted by a grand jury on three federal counts of Internet child pornography that stem back to December 2004. According to authorities, Ward is alleged to have been monitored downloading child pornography, and that he was witnessed in a chat room where child pornography images were sent and received. InsideBayArea.com reported that Ward sent some of the images to a woman in Oakdale, CA, who called police, who referred it to the Federal Bureau of Investigation. Federal authorities seized his computer in early 2005, but found no illegal images on the hard drive.

Ward's attorney does not disput the activity, but says the child pornography Ward distributed were research for a book on hypocrisy in America that has not been published to date.

IF TRUE - There is your reason for search and seizure and his suspension.
