As far as I'm concerned, sexual activity that involves consenting adults should be allowed, and people should be free to film it, view it, and exchange it. But child-porn films and pictures exist because kids were exploited to produce it.
According to Karel, the photo was something taken at a nudist camp. There is no sexual activity involved. There has never been any claim that the photo showed any sexual activity.
I agree with Karel that this is one of the very very few areas of law where intent is not taken into consideration. We have intent even with killing. You can kill someone and be convicted of murder, manslaughter, or nothing, depending on your intent. Did you kill the person on purpose? Did you kill them out of negligence? Or did you accidentally kill them because you couldn't see them out of your rear view mirror? Nude photos of kids allow for nothing in the area of intent. I think this is wrong thinking.
