Wow, JimA! That's very astute of you to write that Bernis is GUILTY! How long did it take for you to figure that out? Bernie's guilty of researching child pornography, the reason he changed his plea, because there is absolutely no tolerance for distributing that info over the internet. Now, Bernie just has to figure out how the guy from NBC gets away with it.

So then... Bernie is Gulity of being stupid. Or ignorant.

It was actually 8, which means he'd get out in 4. I'm not from California, but apparently some provision allows you to serve half the time. So 66 is 33... which means he'll still get out around age 87. The charges were a lot different, involving some pretty strong stuff about actual contact with a child, IIRC, under 15.

An I-Team report -- how opportune that his former employer is able to exploit this story for the May book.

If found guilty he'll have to register as a sex offender. His radio career ended on 12/31/07. If this hadn't happened he could probably have retired from KGO. Even if he gets reduced time in the slammer this will dog him for life. I wonder if he'll lose custody of his minor kids.

Is there anyone reading this who still believes he was researching a book? I think it's safe to say that the "book" defense goes out the window with his not-guilty plea.
 
It's not a
"not guilty" plea... it's a guilty plea. The statute in question does not allow really for any defenses..including first amendment(freedom of press) defenses. Bernie told me he was working on a book years ago...This was long before any illicit images were sent on the net. I have no idea what the book was about...because we discussed the discipline required to actually write a book...how demanding that is...even though it seems it would be easy. I am an author and I encouraged him to set aside a solid block of time each day..removed from the madding crowd and all distractions. We did not discuss topicality.

Pardons are given out at the end of someone's last term, not the begining.

In this situation he would have to ask President Bush for a pardon during his last days in office during January 2009.

So now Bernie would have to really, really ask for forgiveness.

Pretty sure pardons can be awarded anytime in a presidency, but since they are so controversial they are usually give out late by a lame duck.
 
Bush pardoned Scooter Libby more than a year ago...

Looked up pardons on Wikipedia (I know, not the definitive resource) but here's some of what I saw regarding when a pardon....

The Justice Department recommends anyone requesting a pardon must wait five years after conviction or release prior to receiving a pardon. A presidential pardon may be granted at any time, however, and as when Ford pardoned Nixon, the pardoned person need not yet have been convicted or even formally charged with a crime. Clemency may also be granted without the filing of a formal request and even if the intended recipient has no desire to be pardoned. In the overwhelming majority of cases, however, the Pardon Attorney will consider only petitions from persons who have completed their sentences and, in addition, have demonstrated their ability to lead a responsible and productive life for a significant period after conviction or release from confinement.[5]
 
Are you suggesting that President Obama would pardon somebody just because he or she is a supporter? You've got to be kidding. Whether you agree with him or not, does he appear to be stupid?

Even lame duck Bush wouldn't pardon such a crime on his way out of office, and not even if Bernie was Rush Limbaugh. From what I understand, most of these last minute pardons - even the controversial ones like Clinton's pardon of Marc Rich - are for people who have commited "white collar" crime, theft or fraud. There may be a few exceptions, but the crimes don't generally involve violence, or anything that could be called a sex crime.

That is Bernie sending an aircheck of his program to President Bush and asking for a pardon. And that aircheck just happens to spill over into Ray T's program.

What would be the response from the White House then?

Sorry, Newsperson. I guess my sense of humor is failing me on these Bernie Ward threads. I think I'll go back to the stuff about KFRC and Star 101.3.
