Bonneville wins Jack infringement lawsuit

According to Radio & Records, Bonneville International wins a lawsuit filed by Sparknet Communications, which made the claim that the Whatever We Want slogan Bonneville used by numerous Bonneville stations, including Chicago's own WTMX, infinged on the Sparknet's trademark Playing What We Want, a trademark that Chicago's Jack FM currently uses. With that being a victory for Bonneville, We'll continue hearing "Whatever We Want" on WTMX for quite some time.

Great, now they look like copycats -- go for it MIX

Great, they can continu using it -- and sound like lame imitators. Everyone associates (I know it's a bit different) that slogan with JACK. I would even think that NINE will even start to set themselves apart soon!

Even though JACK is breathing down their neck, THE MIX has been around a while and shouldn't acknoledge the competition, let alone copy their slogan.

It just makes THE MIX sound desperate - great keep using it and be lame.

We in the industry may associate the slogan with JACK, but that may not be the perception in the marketplace. Here in Chicago, the Mix was using it more than 10 weeks before JACK, as Feder notes. And Nine had been using their slogan for about a year. So to the average listener, who's the copycat?

The average listener doesn't give a rat's about slogans or sweepers or any of the stuff radio geeks obsess over.

True, but they do on a sub-concious level. That's why imaging is so important.

That is true. Most people don't even notice that stuff at all. Only us.

The only thing they might notice is that Eric and Kathy talk too much and that Sheryl Crow song is playing every time they turn on the station--which is exactly what Jack wants them to notice.

I don't presume that those calls in the sweepers are accurate reflections of what they're getting, but if Jack does hire jocks, particularly in morning drive, there are going to be people angry at them.
