A Suffolk Superior Court judge ruled today that WRKO/Entercom radio was entitled to exercise the “right to match” provision in Howie Carr’s contract, which allows the station to meet WTKK/Entercom's offer and leaves the popular talk show host in limbo.

The judge's ruling makes no sense in the real world of the "dreaded private sector". Is this judge a ' hack' or what.

It could well happen that he shows up tomorrow morning to do a show in Dorchester and GM and Entercom
could fight it out on a continuing basis, or would his lawyers suggest he stay off air...or continue to do
his WRKO show in the meantime? The judge felt that the agreement wasn't terminated.

Perhaps, Howie will show up as Michael Graham's guest tomorrow morning. That would drive WRKO crazy and what could they do about it. Howie could just be plugging his book or column at the Herald.

Why do they think that Howie is tied to Entercom beyond the length of his contract, which ends today? Even if he showed up at WRKO's studios tomorrow, he would be doing so without a contract or a clearly defined agreement for him to be paid.

Shouldn't he be off the hook with the non-compete clause off the table? It's not adding up.....

Sure would love to hear him pop up on WTKK and shove it in Julie's ear! ;D

Howie received an offer from Greater Media in July, while still under contract to Entercom. Howie presented the offer to Entercom, triggering a right to match provision in his agreement (THE VALIDITY OF WHICH WAS JUST UPHELD BY THE JUDGE). Entercom matched the offer, thus contractually obligating Howie to remain with Entercom for the term of the deal, the next five years. In the eyes of the law, Carr's contract did not lapse because he should now be starting his new five year deal with Entercom tomorrow. Howie can choose not to honor it and not show up at work, or he can work outside of radio, or he can work out a deal to return to Entercom. What he CAN'T do is go to work at WTKK without exposing himself and Greater Media to tremendous liability. Even if Howie was foolish enough to want to do so, Greater Media will never let that happen.

Those of you who buy into the drivel from certain anti-Entercom sycophants should rethink your world view.

Thanks for the explanation, but it can't be that simple. If it were there would be no debate at all, so there must be another side to this.

Again, having the ilk of George Regan defending WRKO says it all.
Not even the hack judge bought all of Entercon's agrument.

Howie, like him or not should be able to work where ever he wants to work. His contract with Entercon ended today.

George Regan can't prance around that one.

It really is that simple. Howie and GM did not feel that the right to match would hold up in court, either that, or that Entercom would let him out gracefully. So far they are wrong on both counts. Perhaps on appeal, he will find a more sympathetic judge, but his odds go down on appeal, so it is not likely. Perhaps he and Greater Media can buy his way out of his new five year deal with Entercom. Perhaps he will choose to work in a field other than radio. But right now, he needs reflect on the beach and decide what he wants to do.

Again, if he just sat out three months, THEN his Entercom contract would have expired and he could have gone to Greater Media. Instead, he accepted a deal in July, triggered Entercom's right to match (thus entering him into a new agreement) and gambled that he could get out of it in court. The fat lady hasn't sung yet, but his odds don't look good.

You have to understand that both WRKO Derangement Syndrome and Howie Carr Derangement Syndrome render the victims unable to read legal opinions written in English.

Especially interesting are cases of those who suffer from both syndromes simultaneously. Casa must feel as conflicted as a blind otter in a fish factory.

Do not think that you will ever hear Howie Carr on WRKO again.
He will appeal and win or in the alternative if Entercom matches Greater Media's offer there is no way the courts would force Carr to accept the Entercom offer over Greater Media.

Can you imagine a disgruntled Howie Carr ripping into Kahn and Shorty and the empty suits at Entercon if he is forced to go behind its mic again. Could be fun to hear Carr go after those frauds but if it happens at all he will do behind a WTKK mic.

Have to support Howie 100% here. There is NO indentured servitude and Lincoln freed the slaves [ he really didn't but that is another story for another time.]
