C.C. Utica stations fined by FCC

On Friday's All Access.com it was reported that the FCC fined CLEAR CHANNEL stations in Utica for missing issues/programs lists in their public files. WRNY-AM/ROME WUTQ-AM/UTICA, and WADR-AM/REMSEN, NY were hit for $4,000 each and WUMX-FM/ROME, for $10,000.

Interesting. Sounds like the outgoing PD of Mix decided to "misplace" a few things before he walked out the door. He was there for a pretty long time too, he must have really had it with the company.

On a side note, if the FCC really wanted to get ClearChannel good, they should have someone pay close attention to the timing of the legal ID's on those stations. During periods of automation, especially overnight, it's not uncommon for legal ID's to fire several minutes away from the top of the hour -- when other "verbiage" airs at (or much closer) to the top. FCC regs say the ID has to be as close to the top of the hour as possible. If the ID fires at :52 and some other imaging liner fires between songs at :59 or :01, that's not really full compliance, is it?

Sec. 73.1201 Station identification.

(a) When regularly required. Broadcast station identification announcements shall be made:

(1) At the beginning and ending of each time of operation, and

(2) Hourly, as close to the hour as feasible, at a natural break in program offerings. Television and Class A television broadcast stations may make these announcements visually or aurally.

If I were the FCC, I'd say if you could feasibly run an imaging/positioning liner between songs at :01 past the hour, you could have feasibly run an ID there.

Guys, get those music & traffic logs timed out better! Some of the Syracuse FM's could do a better job in this department too. It's not rocket science! All it takes is for someone to roll an aircheck, catch the ID firing at the wrong time (or not at all), submit it to the FCC and you're busted.
 
Nope, not the old MIX PD who recently left. Was people before that team I hear. Violtations date back from 4-5 years.
