Can JVC force a 105.3 translator off the air?

There's this translator on 105.3 in Fairfield, CT that interferes with Party 105 from Stamford to Stratford. With 2 cases of translators forced to shut down due to their interfering with out of market stations, could the 105.3 translator be forced to shut down because it interferes with Party 105? That 105.3 translator has been on for years and it is useless because there's a translator on 91.9 from the same tower translating the same station.

When this translator first came about (which is tied to WMNR in Monroe, CT), I was pissed because whenever I did my drives along I-95, Party 105 came in the strongest around Fairfield/Bridgeport/Stratford and this translator overtook the signal. But from what I understand, since WDRE's (at the time) market served Eastern LI and NOT Connecticut (although the signal did reach out there in certain parts over the sound) that is why WMNR was able to put their translator there and could legally do so, even though 91.9 was still able to be heard there as well.
 
47 CFR 74.1204(b) states that a translator's obligation to resolves interference complaints arises "whenever reception of a regularly used signal is impaired..." and has repeatedly found to not be limited to listeners within the full-power station's protected contour.

If JVC were so inclined to pursue it, they could collect several complaints of interference and bring it to the FCC. If the translator was not able to resolve every interference complaint, they'd be required to cease operations.

In the latest case out of Detroit, it was noted in the Commission's letter that while all of the complaints came from within the full power station's protected contour, it certainly wouldn't be limited to only complaints within the contour.
 
The Detroit translator only had 13 complaints and was forced to shut down. I'm sure they can find at least 10 Party 105 listeners in Connecticut.

Hmmmm....based on the ratings, I wonder if you could find 10 Party 105 listeners ANYWHERE.
