Can WNYZ get must-carry status?

What would it need to do to get carried by the cable companies?
Could its cable audio signal be modulated for TV, and still keep FM modulation over the air?

If they ever do get carried on cable, they'll hope for cable leakage to enhance the signal.

It won't qualify for must-carry. It will fail under:

47USC534(h)(2)(A):
(addresses local news not provided by full-power stations due to their distance from the community of license. There are of course seven full-power stations licensed to the *same community* as WNYZ-LP. (not to mention numerous full-power stations licensed to other NYC-area communities) WNYZ might argue that these full-power stations aren't fulfilling the public's need for information, but they can't reasonably argue that's due to the stations' distance from NYC!)

(LPTV's city of license and the cable system are both outside the 160 largest metro areas, and the city of license has a population less than 35,000. Of course, NYC is metro area #1 and has a lot more than 35,000 residents!)

That doesn't keep a cable system from carrying them voluntarily. Unlikely to happen without a significant payment from WNYZ's owners to the cable operator. Stephanie's comment about "renting a slot" is probably the only way they'll get on. (that does happen, though I would imagine it's VERY expensive in NYC!)

Yes, I would think the cable system could carry them with TV modulation even if they're using the FM standard over the air. (but I doubt they'll continue using FM deviation levels over the air for long, as that's blatantly illegal)

Um, TV audio is FM modulated just like FM radio. That's why you can pick up channel 6 audio on the low end of an FM radio, which is how this whole thing got started.

Not entirely. For TV audio, 100% modulation is defined as +/-25kHz. For FM, 100% modulation is defined as +/-75kHz. (this is why channel 6 TV audio sounds soft when you listen to it on an FM radio)

My point was that it isn't a different transmission type like AM vs. FM or something like that.
