On the other hand, could he milk this into publicity for Sirius and his show specifically? Could he draw enough attention to himself to garnish enough new subscriptions, and cover the legal fees? Stern is a self-promoter and might be in a class by himself in that respect, and if he could increase revenues while playing the victim, he will be the genius that he says he is.

Here's an interesting idea: If indeed the doo-doo hits the fan for Sirius, could this be a ploy by CBS to settle with Sirius out of court for a percentage of ownership in the company? Has anyone considered that possibility or is there no legal merit to such a possibility?<P ID="signature">______________

The only reason they might have a case is for mush-minded jurors.

Any fool can see CBS had the remedy for these supposed damages and chose not to act and they chose not to act it must have been because they were not being damaged. Stern got something but so did they.

he may increase revenue..but I beleive he gets a static pay, not commission on sales.
It's just interesting that Stern got paid by Sirius for mentioning Sirius, while broadcasting for CBS, and CBS was not compensated by Sirius. That's illegal, but CBS could have fired him...this case might be fun to watch.

While I don't like Howard Stern, the lawsuit is frivilous and if the courts are smart enough, they'll toss this lawsuit out. CBS knew about Stern not renewing his contract and could have done more to stop him from promoting Sirius on their airtime, but didn't. I agree with those who believe that CBS is suing Stern now because of their severe drop in ratings. Chicago has Rover now on mornings on Chicago's WCKG, and he may get the ax by the time the Spring P1's get released. The ratings don't compare between Stern & Rover. As many people on the Chicago board thought, they should have put Jack on WCKG instead of WJMK. Now WJMK's ratings are dropping way down since its launch and now with Stern no longer on WCKG, their ratings are taking a big hit for the FM talk radio station. Good thing Stern left when the timing and offer came around. I have to give him credit for that.

Although I find the suit odd, I did hear something that CBS could stand on...Howard was deue the shares of stock at the END of his contract, not right away. The stock was contingent on Howie getting a certain number of subs. Although CBS was made aware of Howie GOING to SIRIUS, and that the payroll amount was leaked/disclosed, the STOCK portion of it was not ever disclosed to anyone. If CBS knew Howie's stock deal, he might have been fired prior. CBS's complaint of using the show for personal gains has some merit. Did CBS f up? Of course. Did Howie use sone shady moves to gain $220 million dollars? Of course, that is Howie's way. CBS would have never let him stick around if they knew Howard's main objective was to use CBS for nothing but a commercial for what was initially a $110 million dollar bonus. Howie was sneaky so CBS is countering.

Even with the money Howard is making, he couldn't buy this much publicity. Besides he needs a villian to rant about. CBS did him a big favor.
