CITADEL - ADDING INSULT TO INJURY

We terminated affiliate agreements with Citadel because of the numerous issues after the November bloodbath.

This morning I received correspondence from their attorneys indicating that my termination (in accordance with the agreement) violates the "automatic stay" imposed by the Bankruptcy Code, and that if I don't withdraw my "purported" notice, I may be subject to sanctions and more severe penalties.

My God, what could possibly be a worse sanction than the mess we've been dealing with on the air?
 
Bill, Given the end of an existing agreement though, would you still be required to carry their programming or spots? I'm not a lawyer, but it seems like you could effectively put-them-on-notice, that upon completion of the bankruptsy process, you will not renew the expired agreement due to changing programming on your station.

I'll bet you're not the only one in this situation.
 
UPDATE - Following my post this morning, John Rosso called me and personally who apologized for the legal correspondence, and told me it should not have gone out to us, that it wasn't their intent to do this to us.

It appears that an over-zealous lawyer decided to interpret our affiliate agreement in a way which does not seem to correspond with the intent of the Bankruptcy Code, or perhaps just didn't read it.

Aside from the recent technical problems we have had with Citadel, as well as philosophical differences which helped us decide to take a different course, I have found John Rosso to be upstanding and sincerely concerned about improving their product. I've probably mentioned this before, but Jodie and Donna in affiliate relations are also extremely interested in doing what they can to take care of affiliates.

That's great Bill. The lawyer is probably overwhelmed by all the creditors and clients looking for either refunds or their money. Your letter probably got lumped in with them.

So I hear a rumor on the Seattle Board that Pat Cashman will be doing mornings? He's run out of Seattle stations so... ;)
