Normally that would be a matter of specific contractual language (or the specific language of the decision that voided the contract)...anyone who knows its provisions would be in the best position to guess on that. A lot of other issues can come into play...we know non-competes now have no legal force at all in New York, meaning Savage is free to go on the air in New York or any other market in the state. But that may not apply nationally. So would Savage WANT a NYC market-only show, or a New York-based show only sent out to WOR and to stations in the state's other principal markets (Buffalo, Rochester, Syracuse, Albany) at least for starters, as he relaunches his radio presence? Might he want to, or have to, return to the NYC area (where he was born and grew up) to do the show, or could he try doing it from his current home in California? And how does he feel about Clear Channel, who directly or indirectly might be involved with his next show and provide most of the principal in-state affiliates?
He probably needs a little time just to sort this all out, clear away the debris from the court battle, and feel potential stations and syndicators out. He may well have fans eager to hear him again (along with his share of detractors who hope they never will) but there's a lot to figure out any time you have to rebuild a show from scratch after you've cut ties with the people who carried you up to now.
Taking all that into account, it's possible he's renting out carriage of his selected past shows (which he got full control of as part of the judgment), for WOR to keep airing while both he and the station figure out what may be next.
