Dave Herman

Caveat : WNEW-FM was never a listen for me even back in the AoR contemporary days. Heck, though I was
working AoR at the time, Gene Klavan on the *AM* side got most of my TSL then.
So I'm totally unfamiliar with Dave Herman's air work.

Others were not unfamiliar with his air work, though. It's unfair to claim that someone isn't influential
or is untalented just because his or her show isn't one you set your personal clock radio to hear.

There are a half-dozen radio people I could dismiss, through my own standards, as having been un-talented, or
insist that 'anyone can do that'.
And if it hadn't been for this reeking, industry-wide cesspool being uncovered, Dave Herman's air presence or career would not be a part of the equation. He would simply be regarded as one of the many who passed through the studio doors of a legendary and influential radio station. Doing a *morning show* at WNEW-FM (which, again, I never tuned in) ..... a station in the country's top market ...... at a station where the influence was company-wide in other major markets ..... takes talent other than the ability to wake up at 3:30 AM.

Unfortunately, the damage has been done. The man chose to take a flight on the wild side. The uproar and the industry-wide betrayal and treachery (listeners and radio workers) seem to be the prevailing issues in the hundred or so comments I've seen. Air-talent ability is an ex post facto issue.

Keep in mind regardless of one's personal opinion of Mr. Herman and regardless of the amount of evidence collected in this case, Mr. Herman is still innocent until proven guilty beyond a reasonable doubt by a competent jury in a court of law. My comments are not necessarily in defense for Mr. Herman, but rather, in defense or the United States Constitution, the Bill of Rights, and the general rule of law afforded to all of us.

If he is found guilty, he should be sentenced to listen to "In-A-Gadda-Da-Vida" in a continuous loop for the rest of his life!

Then there's the Court of Public Opinion. Court is now in session.

Guys,

I'm surprised that plays on radiation burns aka rf burns have not been used more frequently here than this, but R. F. Burns is a separate account than our long-time friend R.F. Burns.

Best,

RD Rep

All Access.com now has more from Dave's lawyer. Appears he is saying
Dave was involved in a fantasy life & never meant to hurt anyone.

Dave Herman appeared in federal court in Newark, NJ today.
No plea was given. He remains in custody. A bail hearing willl occur soon.

the charges against Dave Herman were read by the judge. Seems odd no plea was
given. But, Dave's lawyer seems to indicate Dave willl plead not guilty. A bail hearing
should occur soon.
