Deal with 1580?

Is WVKO-AM going to be up anytime soon? Isn't it supposed to be sold (I don't recall seeing that it was)?? Maybe the liberals could pool half a million together and get their station back.

There is a new group controlling 1580 as well as WVKO-FM since Stop 26/Riverbend went belly up. Plans are for 1580 to be back on the air "in the Spring." They are supposed to be constructing a tower off of Morse Road close to where Media Play used to be. But I don't believe they have even broken ground.

WVKO has yet to break ground at their new site. If they don't have the site built by May 5th of this year the FCC will likely cancel their license because this is date of the one year anniversary of WVKO going dark on May 5, 2006. Stations that are dark longer then a year automatically lose their license as a matter of law. So, It's not looking good for WVKO every making it back on the air any time soon, if ever.

Note this excerpt from the May 06 issue of The Columbus Dispatch below:

WVKO (1580 AM)
Cash-strapped station pulled from airwaves
Saturday, May 06, 2006

THE COLUMBUS DISPATCH

"That’s because relatively few people listen to the station. According to the latest Arbitron ratings, WVKO finished 28 th in the Columbus market, next to last. The station has 10 days to inform the FCC that it is off the air; if it stays off the air for 12 consecutive months, it will lose its license."

Dispatch reporters Molly Willow, Bruce Cadwallader and Kevin Mayhood contributed to this story.

Actually this is not exactly correct. On 11/17/06 they filed and were granted an "EXTENSION OF REMAIN SILENT AUTHORITY" http://svartifoss2.fcc.gov/cgi-bin/ws.exe/prod/cdbs/pubacc/prod/app_det.pl?Application_id=1158574

Or does this still mean it expires 5/5/07?

Yes, The FCC only gave them until 5/5/07 to remain silent. The towers are down at the old site and it's not likely that they could build the new site within 90 days during the winter unless they get some type of STA.

The following excerpt is from the FCC MINOR MODIFICATION TO A CONSTRUCTION PERMIT that was granted to WVKO on 09/22/2006:

http://svartifoss2.fcc.gov/cgi-bin/ws.exe/prod/cdbs/pubacc/Auth_Files/1141607.pdf

Application Type: MINOR MODIFICATION TO A CONSTRUCTION PERMIT
Status: GRANTED
Status Date: 09/22/2006
Expiration Date: 05/17/2007

4 ***NOTE TO PERMITTEE***
Notwithstanding the grant of this construction permit or the
expiration date specified herein, your station's license will
automatically expire as a matter of law on 5/5/07 if the station has
not resumed broadcasting before
that time. See Pub. Law No. 104-104, 110 Stat. 56,
Section 403(1) (1996) and Order, Silent Station Authorizations,
FCC 96-218 (released May 17, 1996). See also
Public Notice, Expedited Processing of Applications Filed
By Silent Stations, DA 96-818 (May 22, 1996).

To maintain the license, the licensee of 1580 can construct a temporary antenna structure and a transmitter facility and then apply for a STA to begin operations at reduced power before the deadline.

This facility could be little more than a light pole with a unipole antenna being fed by a 250 watt transmitter. For audio, a computer running Music Match Jukebox into a limiter would get it done. This type of setup could be assembled in 2-3 weeks.

The goal is to be ready to broadcast SOMETHING by the deadline.

I had the opportunity to conduct a due-diligence inspection WCIN in Cincinnati a couple of years ago. They had been running on an STA for a long time and their 9 tower site was nowhere near ready to operate.

As long as the licensee is trying to get it built, the FCC is agreeable to extend the STA to finish the job.

Ok, this makes a lot more sense. Bernard Ohio/Zwirn isn't in the business of LOSING money and they would basically be throwing a "valuable" commodity out the window because of lack of action. This isn't the first station they have repo'ed and resold so I figure they know what they are doing.

If only they knew what they were doing when they LENT money to these marginal operators.

They knew precisely what they were doing. Percy Squire accused them of predatory lending. That's his opinion but in my opinion, Caveat emptor.

Agreed. But unless Squire is on the hook (and even if he is but has no cash), the assets sold at a bk sale won't fetch enough to repay them. If they're really lucky, they'll break even. Whoopee!
