distant am signals on a fm hd channel

Would it be legal for a FM station in Alabama, for instance to rebroadcast a 50KW clear channel signal on one of its HD channels? It would be only at night except for WSM, here in north Alabama. This may seem like a stupid question, but I'd still like to know. Thanks.

The stupid question is the one not asked...

As long as the FM station has the permission of the AM station being relayed & runs legal IDs (for the FM HD) on the hour, it's perfectly legal.
 
From my understanding, CBS Radio is doing that very thing by broadcasting WFAN New York on HD subchannels of some of it's stations in Florida. Though I'd imagine that they'll use a satellite or fiber optic feed to do it and would certainly not rely on skywave.
 
Wouldn't there be a problem with, lets say, NY lottery spots on a FL station? I know there are tones and such, but that
is alot of work for an HD-2 channel.

IIRC, and it has been over 20 years since I have been behind a mic, that the only lottery spots
a station can run is if they are in the same state as the station. Alot has changed in the 20+
years, so I could be (and probably am) wrong. But to broaden the question, the local spots advertising
a deli in NYC, in Tampa could be a turn-off, unless you are a snowbird from Queens ;D

I don't think that's true because New Jersey Lottery spots run on New York and Philadelphia stations. However, state lottery commissions tend not to buy spots on out of state stations unless absolutely necessary.

WGBO used to be the Chicago area station that carried the Hoosier Lottery & I believe Powerball until the end of 1994 (plus Hoosier Millionaire, the game show). When WGBO took over & went to Spanish language programming, WJYS carried it for a brief time (at least the Hoosier Millionaire Game Show). After that, WYIN was only carrying Hoosier Millionaire, but not the drawings. So unless some Lake, Newton, & Jasper County residents can get South Bend stations OTA, then we're left out of Powerball & Hoosier Lottery drawings. We have to wait until they appear in the paper the next morning, & when the info gets posted to the Hoosier Lottery website.

At least Racine, Kenosha, and possibly Walworth Counties of Wisconsin, & select Lake County Illinois residents can get both Chicago & Milwaukee stations. So they don't miss out on either states' drawings. Now for Lake County Illinois, only WMVS is carried on cable, so only those residents don't get Milwaukee station unless they watch OTA.

At least for the few times I visited a friend in South Bend Indiana, I always remembered that only the Hoosier Lottery was shown, but the news would show the lottery numbers for both Indiana & Michigan.
