Strange morning in radio Land... It must have been a dream.

8:00 AM, I expect to hear Beatles, I hear Elvis.... double check the display.. yep the right station is on, wrong artist. OK I like Elvis, it isn't Jay Gordon's "Elvis Only" but I'll play along.

8:05 ahhh here is the intro music I know and love... 30 seconds of it when the mic opens and what do I hear?

"FU&*@NG A@#^*LE" (yep un edited, unbleeped $37,500 mistake.)

followed by a little in studio discussion of the mistake that caused the profanity laced tirade, and the decision to try the intro again.

Take Two.... all goes well and the show goes on.

Now I know this isn't being done live, so the 64 dollar (or is it thirty seven thousand five hundred dollar question) is who failed to stop the recording and reset things, or who forgot to edit it out before they loaded it in for airplay?

It can be on the podcast without a problem legally, and unless CBS radio has caught wind of our little discussion and dragged the Boston clusters webmaster in to edit the file and re-post it, or delete it all together, chances are it will stay that way, at least till monday sometime.

The only issue legally would be if someone filed a complaint with the F.C.C, and I don't see that happening.

If the board op was smart, she would have logged it just to cover her backside.

The legal issue hinges on if this was "fleeting profanity" which they had no control of, or is it a violation of the Pacifica decision. The U.S. Court of appeals overturned a FCC ruling back in 2007,letting broadcasters off the hook for incidences of profanity getting on the air if the broadcaster had no control over it. The decision was a relief to sports broadcasters who would get some drunken idiot in the stands yelling something that got picked up by an open mic. The other caveat here is that Appeals Court decision was specific to live broadcasts. The FCC has appealed this ruling to the U.S. Supreme court and it will be heard this fall, the first time since the Pacifica decision that the courts are going to take a look at the FCC rules regarding curse words. The ruling by the US Supreme court could open the door to either more restrictions on words the FCC doesn't like, or it could go so far as to nullify the Pacifica decision and allow broadcasters to air what ever words they want.

Generally the FCC dismisses complaints where on-air announcers inadvertently uttered profanity, which is probably where this would fall, if it wasn't a CBS station, the people who gave us Howard Stern, Boob-Gate, O&A's "Sex For Sam III" cathedral incident, and others. Their relationship with the F.C.C isn't exactly warm and fuzzy ya know.

PS...as of 9:33 pm, the original segment is gone and is now replaced with a different intro...so someone caught on! :)
 
I must've tuned in just after that happened Sunday morning. I heard Chachi back-announce the Elvis Beatles cover he played, and then the rest of the show.
 
I heard it LIVE over the air, I try to take the dogs out while that is on so I can listen to it... I really thought I was listening to WODS until I looked at the radio and saw 100.7 on he display. It was a WTF moment when I heard it.

I saved the podcast for future reference.
 
Weekend jocks (not all of them) at ZLX, have been very loose with the format lately. Playing one song. Than talking over 5 minutes about nothing. Now this incident with Chaci.......Whats next??
 
Hey, I heard Chachi say "The Beatles Suck" too! I also heard him say "I love hairy balls" which I thought was really innapropriate to just come out with during a normal conversation! I love Chachi though, Did you know that he knows Tony Bennett personally? Chachi is a real good sport, and the classiest man in radio!
