"Damages" have already occurred to Power. SBS needs to cure or quit now as they have violated their contract with Emmis. Regardless, they'll need to pony up damages (money) to Emmis.

Latino is not going to be on 97.9. If they were going to do that, it would have occurred prior to it hitting the airwaves on 96.3. And as David Eduardo previously posted, it likely would require the o.k. from their temperamental morning guy as well as MILLIONS to promote the flip of both stations to new frequencies.

My prediction is SBS's Latino 96.3 format will eventually be forced off the air and the lease (contract) on the transmitter location will be fulfilled.

SBS didn't make any headway in its lawsuit against HBC and CCU. But this case shows who really wants to operate lawlessly ---> SBS.

I hope Emmis can get some immediate relief, though. SBS should be forced to c&d from airing the Latino 96.3 format. Otherwise, this may drag into the courts for years.

The subsequent upgrade of 96.1 in San jacinto following the KXOL move precludes moving back to the old site witht he same facility. Overlap, in a word.

Can KXOL not go back to the old site at its old power. KWIE was upgraded before KXOL applied to move to their new site at 27.5k?

I believe there was further enhancement of the KWIE operation, or so the engineers tell me. It appears that KXOL would have to reduce power or directionalize to go back to the KRKD site.
