Eric's comments on the firing

Eric Von Haessler just sent out this open letter:

Rodney,

This is my response to all the latest tom-foolery.
I've posted it on my blog and included it below:

To whom it may concern,

I write this as a man who has just been mugged. Your
faithful radio friend feels as if he’s just been run
over by a Mac truck and left for dead in the middle of
the road.

For reasons known only to themselves Clear Channel has
decided to fire me with cause based on trumped up
charges that have been fabricated out of thin air.
They have also lent their moral weight to a lawsuit
filed against me by the hosts of the Viva morning
show- a lawsuit which also happens to name them as
defendants as well. Seem strange?

It is strange and gets stranger with every passing
day. First of all, how did I ever get to a point in my
life where I’m being sued by guys named Yogi and Panda
over jokes made about their bathroom habits? It’s all
in the company you keep, I guess. But I digress...

My first reaction to all of this in the press was that
I would fight to the bitter end. After all, I’m right
and they’re wrong and justice should be served. But it
turns out that justice is a murky and possibly
prohibitively costly concept to secure.

Every lawyer I’ve consulted has assured me that I have
the facts on my side and that for just a couple of
Brink’s trucks full of cash they’ll be glad to present
my wonderful case in a court of law. The problem is
that it’s likely to cost more money to win than the
amount of money I would actually win- if I won. In
which case I would have simply wasted a number of
years of my life tilting at windmills. Not a prospect
I look forward to.

I’m sure the folks at Clear Channel reading this are
all smiles, since rolling over the little guy is what
they’re designed to do, but I’m beginning to come to
terms with the fact that sometimes the bad guys win
and there’s absolutely nothing you can do about it.

I’ve been ambushed and I don’t know that there’s any
reasonable expectation that a person can beat an
ambush. So I’m thinking that I’ll just hire no lawyers
and defend myself until judgments are made and all of
this gets moved into the past.

The sad fact is that I know I’m in the right but I
don’t think I have much of a chance against these
guys. That’s humbling and instructive, but true.

It is important to me that fans know that I’m not full
of B.S. here. The ‘controversial’ on-air bit that
sparked all of this was approved beforehand by
management. I, as an employee, do not have the right,
let alone the duty to overrule management and kill an
approved segment. Clear Channel knows this to be true,
but they also know how much it will cost me to prove
it.

Clear Channel has also helped spread the idea that I
was somehow involved with creating a hostile workplace
for those working on the Viva staff. Which is
interesting since I haven’t had a single conflict with
any member of their staff at any level- sales,
programming, promotions, or any other department, in
the nearly two years since my return to the building.

What Clear Channel and the hosts at Viva are doing to
me and my family is immoral. But I’m learning that
morality and the law are kissin’ cousins at best.

Honesty and integrity are quaint notions that I choose
to live by. But they don’t have much currency when
you’re up against immoral people who know how to work
the system.

Bringing honesty to a battle with Clear Channel is
like bringing a knife to a gunfight. So I think I
might just go have a beer instead.

The hardest part in all of this is keeping from
becoming completely bitter about everything that’s
going on. But that’s a battle worth fighting. I won’t
give into bitterness because, if left unchecked,
bitterness consumes and eventually destroys the soul.

I’ve been ‘blessed’ with the Chinese curse of an
interesting life and I wouldn’t have it any other way.
My family and I will just huddle up with friends and
loved ones and wait for the storm to pass.

It will pass.

They always do.
 
The thing that I question about EVH's letter and woe-is-the-little-guy approach is: Clear Channel is suffering in this too, not just TRG. Not in the legal fees arena maybe, but absolutely in ratings and revenue. I'm guessing that billings will plummet as they did the first time TRGs were canned. I also assume that the drop in revenue will be far greater than the cost of employing TRG.

Yet, EVH intimates that the CC execs are laughing over all of this. As a matter of revenue, ratings, cluster morale, prestige, PR, fall book momentum and a hundred other ways, CC is a bigger loser over this matter than TRG.

And, as for the "how could I overrule management on playing the bit?" excuse, I'm quite certain TRG have the power to NOT broadcast a bit anytime they want. Come on.
 
Eric has obviously gone through the various stages of emotions and wisely faced the facts. Some people hang on to those bitter feelings for years and it poisons them. But his words are so true. They (the company) will screw you any way they want, whenever they want, without regard for the facts. They circle the wagons and you will never win. They have people on staff whose job is to ruin your life with lawyer fees, depositions, delayed hearings, and years of anguish. As for CC "management": spineless. That whole operation is a joke. So yeah, you've got a top 5 station (Viva). But the PD doesn't even speak English! How is management supposed to know what's really going on day-to-day?

Eric got screwed by professionals but he's a stand-up guy, and smart. He will land somewhere.

Let this be a lesson to us all.
 
Could Eric and Mad Pundit Radio end up on another station, like WSB in the evenings? Listening to Chris Krok, there is no way he could be a replacement for Neal Boortz, as has been mentioned in the past. ??? 8) :eek:

That was my first thought. Somebody over there loves Krok so I do not see that happening because he was selected over Royal. However, I would be more likely to dial in WSB on the weekends if there was an entertaining live show instead of reruns of Boortz or Hannity.

Think someone at WSB would be willing to roll the dice and give Eric a weekend show?

Mr. Weber is looking for more business oriented shows. Pete and Wayne had a peaceful parting of the ways with 1160 because incorporating a business element in their show was not ssomething they wanted to do.

So . . . How about a little time on WSB for Eric as well as Pete and Wayne?!

I don't think WSB would bid on that puppy. I read in Rodney's AJC article a quote from Chris Wegman that pretty much closes the door on EVH.

I think he would be a much better fit on WSB than Krok. At least he knows Atlanta. Listening to Krok is painful. For a new drinking game, try taking a tequila shot every time Krok does a 5 second pause. You will be drunk in 5 minutes.

I agree that Eric used a pretty lame excuse for airing the bit. "How could I not use it?" Gimme a break. I do think he got the bad end of the stick. This seems like Larry messed it up for everyone.

How come no one is addressing the main reason CC cut the rope. It is illegal to record someone and air them without their permission. If a PD said you can cuss all you want, would you swear all morning? I work in real estate and even I know that you have to have permisson before you put someone on the radio. Plain and simple. Come on Eric.

I've seen a few posts about Eric's statement that he had no say in the playing of the bit. Here is my take on his statement: the PD green flagged the bit and, obviously, Larry wanted to run the bit. More or less, Larry always seemed to run most (or all) aspects of TRG's show.

I would bet that Eric intended to convey that he couldn't do much to stop Larry from running the bit. It's questionable if he should have been fired at all for this reason; however, we know that he was fired along with Tim Andrews (Porn Czar) and the show's producer(?), Spencer. It seems CC didn't much care to place proper blame.

A lot of this opinion is based on the fact that Larry and Eric often gave the impression of disagreeing, not knowing if this was "just part of the show".
 
Eric's a really really good soul that doesn't deserve what's befallen him. I'm certain they'll be better off in the long run. If I were Clear Channel I'd feel compelled to let Yogi and Boo Hoo go too.

Yogi and Panda would be well advised to keep an eye out for future options as time progresses towards the end of their contract . . . CC is probably looking for a reason to get rid of them as soon as possible.

By the way, was the restroom behavior that The Kimmer spoke of in the past regarding the CC restrooms directly related to the restroom behavior of Yogi and Panda?

On a personal basis, I am reviewing my residential tenant leases . . . No more slack to my Hispanic tenants . . . Christmas is comming and I need some extra money. If Panda and Yogi can screw folks, so can I!
 
There's no question Eric is a class act, however it shouldn't be overlooked that he somewhat made this own bed on this one. As a reminder, after a Larry Wachs bit got them fired the first time he swore he'd never work with Wachs again. But then CC threw enough dough at him a year or so later and, lo and behold, he was once again a Regular Guy.

Bottom line: he knew very well who he was getting into bed with again but the money talked. Of course, I definitely understand a guy needing a gig and not wanting to pick up his family and move, but it's like the saying goes: "Fool me once, shame on you. Fool me twice, shame on me."

It's not like they recorded some Joe Schmoe in the restroom of the local Crapplebees, they recorded another broadcast team in the restroom of the CC building.
So, are you saying one pair of broadcasters cant record another pair they work with in thier own building and air it? Would it have made any difference if they recorded them at the water cooler, or the hallway?
I've heard some jocks play the home phone messages of competing jocks that were sent in by members of thier family. Is that Illegal, too?
Help me out here. Where is the legal line drawn? Live prank phone calls illegal, too?
 
Yeah, Eric is a "good soul"---secretly taping someone in a restroom and playing it on the air, and breaking federal law in the process. A real class act. CC made the right call on this one. Goes to show, it doesn't always pay to be racist...

Oh yeah except Eric did not secretly tape anyone nor is he a racist but go ahead and paint with your wide brush.

Also Yogi and Panda must agree on Eric because they have dropped him from their lawsuit and now they are only suing Larry.

Quick education for you: It's flat-out illegal to tape someone without their prior knowledge, period. It's also illegal to put someone's voice on the air without their prior consent. Jocks have done it with other jocks because they know most won't sue each other over it (except Paco and Jose, or whatever the hell their names are). Live prank calls have always been illegal but companies and the FCC didn't start cracking down on them till a few years ago. That's why you hardly ever hear them anymore...unless they're faked (see Bert's War of The Roses).
