FCC ANNOUNCES LPFM WINDOW

Gene:

I know we have corresponded in the past..I will be applying for one. I am just a little too bored being "on the beach."

Hope things are going well at your station.

Now trying to raise the money needed to things off the ground.  If anyone reading wants to help, contact me off site or at this address: [email protected] and I'll tell you where to send a cash donation.  No checks or money orders please.  The money in the bank is for me to live on.  Can't use that money period.

R.D.P. <>< (Dan)

P.S. Nexus of Mount Vernon Texas is assisting me.  Trying to get this money raised now.  It'll be due within the next two weeks.  Want to have it in their hands by the deadline.

There are a variety of fundraising websites.

Have you canvased the community you'd be serving? If the local residents and merchants believe you'd be adding a valuable service I would think they would consider assisting you on your quest.

Use caution! If for some reason your app for C/P is turned down or MX'd..you might be held for collecting money for your own use. I would wait until I had the CP before looking for/collecting funds. Plenty of time to build your station and raise funds after the CP arrives...just sayin'

Scratch those thoughts I had.

Now let me clear the air.

The money I'm raising now is for this:

1. The licensing fee.
2. To become a legal non profit entity.

This money is due next month.

Plan on sending it to Nexus Communications in Mt. Vernon Texas, once I get it all.

They're helping me get everything up and running with this dream.

Here's the exact info from Nexus.

The money I need now is this:

1. LPFM Filing For Non Profits
2. Not For Profit Verification/Formation

It's due next month.

Hope this helps.

Dan <><

I dont know who Nexus is, but it looks like they are trying to be a one-stop shop for licensing, equipment, etc. One page mentioned "full service LPFM applications as low as $2500"(emphasis mine). Have you checked with other religious based LPFMs who may be willing to share their experiences getting their license and guide you through the maze? In our state there was at least one group that went around helping other religious organizations with the paperwork nightmare. And again, in our state, one can apply for a non-profit corp online at no or very little cost!

Mr. Alan McCall recommended them to me.

Going to stick with them and see how far we can go.

Hope to make it to the finish line.

Let me get this straight. Frankly, you can be rather vague with what you write.

Are you telling us that the money you're raising now is to form the non-profit?

If so, as I see it, WRPO is correct. You're standing on extremely perilous legal ground. Legally, this is something that can come back to bite you...HARD! You don't want and clearly cannot afford that.

I'll be more blunt. I've worked with non-profits. If you have not or cannot take the first step to form a non-profit with your personal funds, the door is CLOSED. Move on.

Stop asking for funding now. Stop accepting funding now. If you've accepted funding, return it now.

I'd have loved to see you get this done, but I fear that this is far too complicated for you to complete.

Again, I'm sorry but it's time for you to put this aside and move on.

I'm raising money for these two things:

1. LPFM filing for Non Profits
2. Not for Profit Verification/Formation

That's my goal for now.

Will take care of everything else, once these goals have been completed.

Dan <><

P.S. Plan on doing everything possible to see this through. Things may work out yet. Not ready to give up. Thanks for the response. I appreciate it.

Be VERY careful..best to consult legal help...again, be VERY careful. Once again, your licence and construction permit if FREE. Fill it out yourself and save the 2.5 K someone wants to do it for you. (to you..lol) It's not that hard..just answer a few questions. The FCC will even help you if you ask..

Agree partially, disagree partially.

The actual filing with the FCC indeed has no fee attached.

Creating a filing that has a fighting chance of resulting in a grantable construction permit isn't usually something that can be done without professional assistance, though. There are engineering filings that have to be made, and lots of details that can and will catch an applicant if he or she is going into the process as a novice. $2500 does seem steep to me (it's more than I charge my clients, for sure), but there is considerable skill and specialized knowledge that goes into preparing a grantable application, and that's worth something. (What's more, an applicant that can't come up with a very low four-figure sum to get its application right probably doesn't have the resources to build and then operate a station in the long run.)

I agree strongly with other posters here who've warned about the potential dangers of raising money for an as-yet-nonexistent nonprofit. I'd really, really want to be getting some advice from a lawyer who's skilled in these matters before I solicit or accept as much as a dime toward a project like this. At a bare minimum, I'd be talking to my state's division of charities or secretary of state's office to get some guidance on the rules. The consequences of violating some of those rules can be very serious.

I may not take a gamble after all.  May end up doing just what you last three posters are advising me to do now.  It would be far cheaper and less costly if I went about this on my own.  May run with the idea.

Dan <><

P.S. To WPRO, if I went this new route, would you help me fill out the application correctly?  I want to go about this in the right way and see it through.

B.T.W. Could I form a non-profit cheaper that $300? That's the price Nexus was going to charge me to do it. Have a friend that's a lawyer. I'm going to see if he can help me get this done, should the Lord lead me to take this new route.
