FCC Issues Order on XM/Sirius Sub-leasing

I was wondering when they would get around to this--and apparently it's now. The FCC just issued an order regarding the sub-leasing of a portion of their spectrum to Qualified Entities (as outlined in their merger agreement).

The order includes a NCE set-aside and that these leased channels will be available on all pricing tiers. As for who qualifies, the FCC avoided a race-based approach and instead has allowed Sirius/XM to make the determination subject to FCC approval. The only hard qualification is that the entity NOT be associated in any way with Sirius/XM. The airing of commercials will be allowed (except for the NCE set-aside) but not Sirius/XM commercials unless there is a cross promotion.

Wonder if NPR will seek some channels? Apparently 6 channels is the least that can be applied for with NCEs.

I read the whole FCC ruling, AND this is BIG, Mel convinced them that these channels will NOT BE FREE. Yep, in order to sell the merger he promised that any old deactivated XM or Sirius radio could pick up these 6 channels for free - not any more! That really sucks the big one. I don't know if Mel Karmazin is just a big schemer, or a big liar, but he always comes out on top, and the subscribers last.
