"Fresh" Format and Jax

It appears this AC alternative is making inroads in markets such as NY. And so I wonder if Jax will see a flip to this format as a challenge to WEJZ. Also, if those in the know can answer the following questions, I'd surely appreciate it!

Are new formats such as Fresh owned by a specific communications company? Or can any group in any market flip to it?

In this market, I would think Cox Radio would have this on the table as something to consider - especially if they are looking to flip The Point to something else. Thoughts?
 
While a format cannot be copyrighted, the name used to brand and market the format can be.

Example: Movin' (airing on 100.7-FM) which is mostly the rythmic AC of the 90's. Anyone can do rythmic AC, but cannot use "Movin'" without paying the creator.

To avoid the fee, some use alternate names (witness the Jack-imitators, Bob, Fred).

As for Jacksonville, THE POINT was one of those formats/brands.
