Do subchannels of HD radio stations have to have censored programming according to FCC law? Or can they be uncensored like satellite radio?<P ID="signature">______________

They are part of free radio and the same rules apply.

Since they are free-to-air rather than subscription, I would expect the FCC would enforce HD subchannels the same as analog/HD primary.<P ID="signature">______________

The enforcement begins as soon as they budget for HD recievers!

I know you said this tongue in cheek, but some may not know that the FCC does not monitor content and depends on listeners to submit complaints.

The FCC can not even afford to check for pirates and daytimers running late or on high power!

Sadly, that is true. Speaking of pirates, David, here's a question we've been kicking around the Buzznet Media bunker: Howard Stern is safe (at this writing) on Sirius from FCC problems. However, if someone submits a complaint based on a pirate AM or FM transmission of the satellite feed, could they fine Stern and/or Sirius?

I would think not. Remember, back in the days when Stern was on terrestrial radio, any fines went to the licensees of the individual local affiliates, not to Stern directly. So the onus for any content violations would be on the, um, "unlicensee" of the pirate transmitter, though they'd be in big enough trouble just from the $10K hit for broadcasting without a license to begin with. <P ID="signature">______________

The FCC has never limited its indecency and obscenity oversight to the "seven dirty words" to the exception of all else.

Pacifica was much more broad than just seven words.

And from this legal mind, Pacifica was wrongly decided--and horribly so.

Simple question: How would a complainer know (or prove) who's transmitter it is?

I doubt that anyone should be seriously concerned about this.<P ID="signature">______________
